CHENNAI: The Madras high court struck down four govt orders (GOs) that regularised temporary promotions in the Tamil Nadu police, declaring them as being contrary to service rules and constitutional principles.

Justice C Kumarappan passed the order on a batch of pleas moved by directly recruited deputy superintendents of police (DSPs) challenging the GOs passed between 2022 and 2024. The GOs allowed promotee DSPs to be elevated as additional superintendents of police (ADSP) through temporary panels.
Allowing the pleas, the court held that seniority and promotions must be based strictly on substantive appointments and not on temporary or ad hoc postings.

According to the petitioners, the govt violated the statutory 1:2 ratio between direct recruits and promotees under the Tamil Nadu Police Service Rules by granting repeated temporary promotions under the Tamil Nadu Govt Servants (Conditions of Service) Act, 2016. They contended that this long-standing practice denied them legitimate seniority and promotional opportunities.
Opposing the pleas, the state contended that the petitions were delayed by almost a decade and barred by res judicata (issue already adjudicated) due to earlier cases.

Seniority, as per the provisions of the Tamil Nadu Govt Servants (Conditions of Service) Act, is determined from the date of first appointment, not regularisation, the state said.
“Once both streams (direct and promotee) merge at DSP level, maintaining ratio at higher levels (ADSP or SP) is not required. Temporary appointments were valid as a stop-gap measure under statutory provisions,” it added.
Refusing to concur, the court observed that temporary appointments cannot confer seniority over those appointed to substantive posts. Citing several Supreme Court judgments, the court emphasised that the right to be considered for promotion is an integral part of Article 16 (Right to equal opportunity) of the Constitution.
The court then directed the govt to prepare a proper inter-se seniority list for DSPs for 2012–13 and 2013–14 in 8 weeks and to draw regular panels for promotions strictly through the Departmental Promotion Committee.
