COMMON AFFIDAVIT FILED BY THE PETITIONER
I, D. Prakaash Ganth, S/o. E. Dhanasekaran, Hindu, aged about
39 years, residing at 7/81, Y Block, 6th Street, Annanagar, Chennai – 600040, and a practicing Advocate at the Hon’ble High Court of Madras, do hereby solemnly affirm and sincerely state as follows:
1. I submit that I am the Petitioner herein and am fully conversant with the facts and circumstances of the case. I am also the Founder of Heaven for Animals (HFA), a registered NGO (Regn. No. 102/2021), (PAN CARD No.: AACTH4520J) working for the protection of community animals.
2. I submit that this Writ Petition is filed in public interest concerning the recent telecast of the program “Neeya Naana” Episode No. 409 on Star Vijay TV, aired on 31.08.2025, on the theme “Dog Lovers vs. Dog Haters.” No other Public Interest Litigation Petition has been filed by me in this matter and my Aadhar No. 7206 8706 2318. I humbly submit that I am filing this affidavit in the interest of the Public.
3. I submit that the said program carried numerous false, misleading, and inflammatory statements concerning community animals, the Animal Birth Control (ABC) programme, and the role of feeders and activists. The broadcast of such content has led to social unrest, violence against animal lovers, and increased incidents of cruelty against community dogs.
4. I further submit that the subject matter of community dog management is currently sub judice before the Hon’ble Supreme Court of India viz. Suo Moto W.P.(Civil) No(s).5 of 2025 with Writ Petition (Civil) No(s).784 of 2025, SLP (Civil) No(s). 14763 of 2024 and SLP (Civil) No(s). 17623 of 2025, order dated: 22.08.2025 such debates or public discussions overrule and undermining the judicial process ought not to be telecast or encouraged.
5. I submit that by telecasting one-sided and scientifically incorrect statements, the Respondents – 6 to 10 have misinformed the public, created hostility against animal feeders and NGOs, and contributed to cruelty and unlawful acts against community animals.
6. I submit that for the kind consideration of this Hon’ble Court, the following particulars of misleading statements made during the said episode, along with the correct factual and legal position, are furnished as follows:

09:35 “Animal Birth Control (ABC) doesn’t work.” Incorrect. ABC Rules 2001 & 2023 are binding law; the Hon’ble Supreme Court has upheld the “sterilize-and-return” model as the lawful and scientific method.
12:10 “Feeders are the problem.” Defamatory and stigmatizing. Feeders perform a recognized role under law and court directions, ensuring welfare and reduction of stray aggression.
16:20 “Feeding causes bites; stop feeding.” One-sided and misleading. Courts have directed that feeding must be organized at designated spots, not stopped altogether.
30:16 “Law allows culling/relocation.” False. Euthanasia is only permitted for incurably ill or mortally wounded animals. Relocation of community dogs is illegal.
36:00 “Send dogs to forests.” Ecologically unsound and unlawful. Dogs cannot be relocated into forest ecosystems under the ABC framework.
42:00 “Dogs are ‘invasive’ and should be eliminated.” Baseless and inflammatory. Such statements invite cruelty and violence towards community animals.
54:00 “Permanent sheltering is the solution.” Misleading. The lawful and scientific model is Animal Birth Control with return to the same locality; permanent sheltering is neither feasible nor legally mandated.

7. I submit that the said broadcast has had grave negative consequences, including increased violence against community dogs, brutal killings, burning, chopping, and merciless cruelty, as well as targeted hostility and harassment of animal activists, feeders, and NGOs. I further submit that the said episode has instigated violence against community dogs which has led to several instances of uninvited brutality against community dogs leading to their death in some cases. It is further seen that several First Information Reports have been registered in this regard in the days following the airing of the said episode which goes on to indicate that the said episode has imbibed a wrong perception about community dogs in the minds of the people.

I submit that following the telecast of the Neeya Naana show Episode No.409 on 31.08.2025, a series of gruesome and shocking incidents of extreme cruelty to stray dogs were reported in Palladam, Tiruppur District. On 03.09.2025, FIR No. 912/2025 was registered regarding the suspicious death of eight stray dogs. The very next day, on 04.09.2025, FIR No. 457/2025 was filed, wherein a stray dog was discovered brutally killed with its skin completely peeled off.
Subsequently, on 08.09.2025, FIR No. 739/2025 was registered after yet another stray dog was found dead with its mouth and legs tied, and its body cruelly stuffed into a rice bag. These incidents, occurring in close succession immediately after the said telecast, reveal a disturbing pattern of organized cruelty, raising grave concerns about the direct impact of the Neeya Naana program, Episode No.409 in inciting violence against community animals and thereby endangering their safety and welfare in the region.
9. I submit that the content of the programme serves to stigmatize law-abiding citizens who comply with statutory obligations under the Animal Birth Control Rules, 2023, and encourages illegal acts against animals, thereby posing a serious threat to public order and undermining the rule of law and established constitutional jurisprudence.
10. I further submit that such broadcasts, in violation of ongoing judicial scrutiny, are against the principles of compassion and lawful governance, and must be restrained in the larger public and constitutional interest.
For the reasons stated above, it is humbly prayed that this Hon’ble Court may be pleased to grant an interim order to direct the Respondents 1 to 5 to initiate the appropriate legal action against the Respondents 6 to 13 for airing the “Neeya Naana” episode No.409 telecasted on 31.08.2025 and thus render justice.
In the above circumstances, it is therefore most humbly prayed that this Hon’ble Court may be pleased to issue a writ of mandamus or any other writ or order or direction in the nature of directing the respondents-3 not to permit or broadcast in the future by any shows which propagate misinformation against community animals and the settled law under the ABC framework (Animal Birth Control Rules, 2023) as well as the ordered dated. 22.0.2025 passed by the Hon’ble Supreme Court of India in Suo Moto Writ Petition (Civil) No. 5 of 2025 and pass such further or other orders as this Hon’ble Court may deem fit and proper in justice and thus render justice.
