O R D E R
(Order of the Court was made by M.S.RAMESH, J.)
It is claimed by the appellant that without issuance of a statutory notice, when he had appeared before this Court and admitted the fraud of putting the signature of the 4th respondent, the Contempt Court could have given him an opportunity to explain the circumstances under which he had affixed the signature.
2.In our view, if such an opportunity had been given, the Contempt Court could have weighed the punishment options between fine and sentence, as a mode of punishment, which opportunity may have been deprived to the appellant.
3.On this prima facie view, we are inclined to suspend paragraph
No.7 of the order passed in Suo Motu Contempt Petition No.2163 of 2025 dated 25.08.2025 until further orders.
4.Mr.A.Damodaran, learned Additional Public prosecutor takes notice for respondents 2 to 4.
5.Notice to the 5th respondent returnable by 09.10.2025. Private notice is also permitted.
6.Call the matter on 09.10.2025.
