Honourable First Bench after taking note of all the above submissions directed the Government to look into the matter and come out with proper response and post the matter after 2 weeks on 21 st November.

Advocate on record Manimaran -Senior Advocate R Singgaravelan argued on his behalf.There is an inner road called Gandhi Road to National Highways proceeding to Vizhuppuram, Trichy and other Southern States near Vandalur Zoo. Ironically TASMAC Shop is located on the one side of Gandhi road of 20 feet width and on another side of the road is reserve forest backside and side place of Vandalur zoo.It was argued by the Senior Advocate that Environment Protection Act defines hazardous substance and liquor can very well be brought under that.It was pointed out by the Senior Advocate singaravelan after consuming alcohol the bottles are thrown near the fence and some empty bottles as revealed in the photos are thrown inside the forest causing endangerment to the life of the precious animals.The photos filed with the petition would reveal that peacock and deer are standing and staring.He further argued that the Apex court in environment pollution case against the industry like mining in the matter of T.N.Godavarman Thirumulpad vs Union of India reprouced the guidelines framed by the Ministry of Environment and Forest and Climate Change prohibits the usage of hazardous substances near the National park and pointing out what is said in the above judgement at para 28 he argued that the role of the State cannot be confined to that of a facilitator or generator of economic activities for immediate upliftment of the fortunes of the State alone and it also has to act as a trustee for the benefit of the general public in relation to the natural resources so that sustainable development can be achieved in the long term.He brought to the notice of the Bench another decision of the Division Bench which insisted for the revisit of the liquor rules atleast in the interest of the youngsters who are the future architects of the Nation.The Senior Advocate pointed out that though the said judgement was rendered on 03.07.2024,no step seems to have been taken to bring forth necessary amendments atleast to proect temples,schools, colleges, National Parks, residential areas and Zoo by enhancing the distance between the shop and the above public places.
