PRAYER :-  Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents to process the Aadhar Card application of the petitioner’s son viz., T.Madhu Sudhan aged about 11 years in Enrollment No. 2193/12321/02183 and issue Aadhar Card by considering his representation dated 06.11.2025 and pass appropriate orders on merits and in accordance with law within the time limit that may be stipulated by this Court.

ORDER

The writ petition has been filed for a mandamus to direct the respondents to process the Aadhar Card application of the petitioner’s son

viz., T.Madhu Sudhan aged about 11 years in Enrollment No. 2193/12321/02183 and issue Aadhar Card by considering his representation dated 06.11.2025 and pass appropriate orders on merits and in accordance with law within the time limit that may be stipulated by this Court.

2.               Heard the learned counsel for the petitioner and the learned counsel for the respondents.

3.               The learned counsel for the petitioner would submit that the petitioner has adopted one Madhusudhan on 02.08.2018 through adoption deed in Document No.4/45 of 2018 and an application for obtaining Aadhar card was submitted.  However, though an Enrollment No. 2193/12321/02183 was generated, the Aadhar Card has not been issued.  He would further submit when the petitioner and his wife are Hindus and the adopted son is also a Hindu and adoption deed was also executed on 02.08.2018 and it is also registered as per the Hindu Adoptions and Maintenance Act, 1956, the Aadhar Card has not been issued. Hence, the petitioner submitted a representation on 06.11.2025. Since there is no action on the said representation, the petitioner is before this Court.

4.               The learned counsel for the respondents would submit that the petitioner and his wife are Hindus and the adopted son is also Hindu.

5.               I have considered the rival submissions and perused the materials available on record.

6.               Considering the submissions made on either side, when the petitioner and his wife are Hindus and the adopted son is also a Hindu and the adopted deed is also rightly registered as per law, the adoption deed is sufficient to prove that Madhusudhan is the legally adopted son of the petitioner under the Hindu Adoptions and Maintenance Act, 1956. When such being the case, I do not find any impediment for the respondents to issue the Aadhar Card to the petitioner’s adopted son Madhusudhan. Accordingly, the respondents are directed to consider the application of the petitioner with Enrollment No. 2193/12321/02183 as well as the representation of the petitioner dated 06.11.2025 and issue Aadhar Card to the petitioner’s adopted son T.Madhusudhan within a period of eight weeks from the date of receipt of a copy of this order.

7.               The writ petition is disposed of with the above direction. No costs.
