காவிரி நீரை உடனடியாக தமிழ்நாட்டிற்கு திறந்துவிடஉச்சநீதிமன்றத்தில் திமுக அவசர மனு.

இம்மனுக்கள் மூத்த வழக்கறிஞர் பி. வில்சன் அவர்களால் வரைவு செய்யப்பட்டு இறுதி செய்யப்பட்டுள்ளது.

திராவிட முன்னேற்றக் கழகம் (திமுக), அதன்விவசாயிகள் அணி செயலாளர் திரு. A.K.S விஜயன்அவர்கள் மூலம், சிவில் மேல்முறையீட்டு வழக்கு எண்2453/2007-ல் இடைக்கால மனுவைத் தாக்கல் செய்து, தமிழ்நாட்டிற்கு காவிரி நீரை உடனடியாக திறந்துவிடஅவசர உத்தரவு பிறப்பிக்கவும், 16.02.2018 அன்றுஉச்சநீதிமன்றம் வழங்கிய தீர்ப்பைநடைமுறைப்படுத்தவும், காவிரி நீர் ஒழுங்குமுறை குழு(CWRC) மற்றும் காவிரி நீர் மேலாண்மை ஆணையம்(CWMA) வழங்கிய உத்தரவுகளை அமல்படுத்தவும்மாண்புமிகு உச்சநீதிமன்றத்தை அணுகியுள்ளது.
இந்த மனுவில் மாண்புமிகு உச்சநீதிமன்றத்திடம்பின்வரும் நிவாரணங்கள் கோரப்பட்டுள்ளன:
I. 28.07.2026 அன்று காவிரி நீர் ஒழுங்குமுறை குழு(CWRC) வழங்கியதும், 30.07.2026 அன்று காவிரிநீர் மேலாண்மை ஆணையம் (CWMA) உறுதிசெய்ததுமான உத்தரவை கர்நாடக அரசுஉடனடியாக முழுமையாக செயல்படுத்துமாறுஉத்தரவிட வேண்டும். அதன்படி, மாண்புமிகுஉச்சநீதிமன்றத்தின் உத்தரவு பிறப்பிக்கப்பட்டநாளிலிருந்து தொடர்ந்து 15 நாட்களுக்கு தினமும்3,500 கனஅடி (கியூசெக்ஸ்) தண்ணீர்பிலிகுண்டுலுவில் திறந்துவிடவும், 29.07.2026 முதல்ஏற்பட்டுள்ள பற்றாக்குறையையும் ஈடு செய்யுமாறுஉத்தரவிட வேண்டும்.
II. 26.07.2026 நிலவரப்படி, விகிதாச்சார (Distress Sharing) அடிப்படையில் தமிழ்நாட்டிற்குவழங்கப்பட வேண்டிய 9.46 டி.எம்.சி. நீர்பற்றாக்குறையை ஈடு செய்யும் வகையில், 15 நாட்களுக்கு தினமும் சுமார் 7,000 கியூசெக்ஸ்தண்ணீர் பிலிகுண்டுலுவில் கிடைக்குமாறுகர்நாடக அரசுக்கு உத்தரவிட வேண்டும்.
III. கர்நாடக அணைகளிலிருந்து திறக்கப்படும்நீரையும், பிலிகுண்டுலுவில் கிடைக்கும் நீரின்அளவையும் காவிரி நீர் மேலாண்மை ஆணையம்(CWMA) தினசரி கண்காணித்து, அதன் அமலாக்கநிலையை மாண்புமிகு உச்சநீதிமன்றத்தில்அறிக்கையாக தாக்கல் செய்யுமாறு உத்தரவிடவேண்டும்.
IV. வழக்கின் உண்மை நிலைகள் மற்றும்சூழ்நிலைகளைக் கருத்தில் கொண்டு, நீதியைநிலைநாட்டுவதற்குத் தேவையான பிற உரியஉத்தரவுகளையும் மாண்புமிகு உச்சநீதிமன்றம்பிறப்பிக்க வேண்டும்.
கர்நாடக அரசு, காவிரி நீர் மேலாண்மை திட்டத்தின்கீழ் அமைக்கப்பட்டுள்ள சட்டப்பூர்வ அமைப்புகளின்கட்டாய உத்தரவுகளைப் பின்பற்றாமல் காவிரி நீரைதிறந்துவிட மறுத்துள்ளதால், காவிரி டெல்டாபகுதியைச் சேர்ந்த இலட்சக்கணக்கான விவசாயிகள்கடுமையாக பாதிக்கப்பட்டுள்ளனர் என்பதை இந்த மனுசுட்டிக்காட்டுகிறது. விவசாயிகளின் வாழ்வாதாரத்தைப்பாதுகாக்கவும், உச்சநீதிமன்றத்தின் 16.02.2018 தீர்ப்பை முழுமையாக அமல்படுத்தவும், உடனடிதலையீடு செய்யுமாறு மாண்புமிகு உச்சநீதிமன்றத்திடம்இம்மனு கோருகிறது.
 
மேற்கூறிய மேல்முறையீட்டில் திராவிட முன்னேற்ற கழகத்தையும் , காவிரி நீர் மேலாண்மை ஆணையத்தையும் (CWMA) ஒரு தரப்பினராக இணைத்துக்கொள்ளுமாறும் திமுக கோரியுள்ளது.

DMK Approaches Supreme Court Seeking Immediate Directions for Release of Cauvery Water to Tamil Nadu.
The Applications are settled by P. Wilson Senior Advocate.
The Dravida Munnetra Kazhagam (DMK), represented by Thiru A.K.S. Vijayan, Secretary, Farmers Wing (Vivasayigal Ani), has approached the Hon’ble Supreme Court of India by filing a Miscellaneous Application in Civil Appeal No. 2453 of 2007, seeking urgent directions for the implementation of the Judgment dated 16.02.2018 and the enforcement of the directions issued by the Cauvery Water Regulation Committee (CWRC) and the Cauvery Water Management Authority (CWMA).
The direction application seeks the following reliefs before the Hon’ble Supreme Court:
I. direct the State of Karnataka / Respondent No. 1 to forthwith and fully implement the direction of the CWRC dated 28.07.2026, as affirmed by the CWMA on 30.07.2026, by ensuring a flow of 3,500 cusecs per day at Biligundlu for the period of 15 days commencing from date of the order by this Hon’ble Court, and to make good the shortfall in compliance from 29.07.2026 onwards;
II. direct the State of Karnataka / Respondent No. 1 to make good the accumulated backlog of about 9.46 TMC due at Biligundlu as on 26.07.2026, computed on the pro-rata / distress-sharing basis, by ensuring releases such that about 7,000 cusecs per day is realised at Biligundlu over a period of 15 days;
III. direct the CWMA to monitor the releases from the reservoirs of the State of Karnataka and the flows realised at Biligundlu on a day-to-day basis and to report compliance to this Hon’ble Court;
IV. pass such further Order or Orders as this Hon’ble Court may deem fit and proper in the facts and circumstances of the case, and thus render justice.
The application highlights the severe hardship faced by lakhs of farmers in the Cauvery Delta due to the non-release of water by the State of Karnataka despite the binding directions issued by the statutory authorities constituted under the Cauvery Water Management Scheme and seeks urgent intervention of the Hon’ble Supreme Court to protect the livelihood of the farming community and ensure compliance with its judgment.
 The DMK has also prayed to implead itself and CWMA as parties to the above appeal
