It is ordered to deduct the period of imprisonment already undergone by them in the prison, under section 428 of Cr.P.C., The material Objects M.O.1 to M.O.12 seized in this case are ordered to be destroyed after the appeal time is over or if appeal is filed after the disposal of appeal.

This Sessions Case came up before me for final hearing on 15.12.2025 in the presence of Mr.T. Ravi Kumar Additional City Public Prosecutor for the State and of M/s. R. Raghu Raj and S. Jeevitha Counsel appearing for the Accused No.1 and of M/s. C. Sivakumar, A. Manikandan and J.Azharuddin Counsels appearing for the 2nd accused, upon recording the evidence adduced by the prosecution, upon hearing the arguments from the Counsels for both side and also written argument filed on both sides and upon perusing the documents on record having stood over for consideration till date this Court today delivered the following:-
JUDGMENT
01. The case of the prosecution is that, the Inspector of Police F-4 Thousand Lights Police Station, Chennai, has filed a final report for the offences u/s. 302 of IPC r/w Sec. 34 of IPC, stating that on 24.04.2014 at about 21.00 hours according to the complaint given by Mrs.Vasantha, aged 55yrs, residing at No.1, Azeez Mohalla, 6th Street, Thousand Lights, Chennai-6, the deceased Mani was working as an acting driver with 1st accused Kutty @ Manohar for a long time, who is doing Real estate business, having office at Model School Road opposite to Mr. Santhanam (PW-8) shop. The 1st accused Kutty @ Manohar has not paid payment properly and has arrears of payment, when the deceased demanded wages to the 1st Accused in the habit of harassing him by using inappropriate words without paying his salary. Because of this, the deceased Mani used to scold the 1st Accused in front of everyone. Thus the 1st Accused has an antagonism towards the deceased Mani. On the day of the incident on 24.04.2014 at about 6.15pm the deceased with his wife had gone to the 1st Accused Kutty’s office left his wife outside the office. He went inside and asked the 1st accused for arrears of payment, when he slapped her husband on the cheek at the entrance of the office, she immediately ran to that side and said “Don’t hit him, he is old man” but the 1st Accused Kutty @ Manoharan did not listen to her words instead he said ” I wanting for you to get trapped alone, and today you were caught exactly” and also, he hit him on the cheek and grabbed his head by the hair and slammed it against the wall of the accused office, and took the Scorpio car key from his pocket and punched the deceased in the jaw and call his friend Santhosh Gnanakumar who was inside his office. Santhosh Gnanakumar who came out and removed the hand protection from his right hand and punched the deceased in the face along with 1st Accused, both of them joined forces and attacked him with loudly saying you die with this, the deceased Mani was bleeding from his head and month. The PW-1 with the help of her relatives took her husband, who was fighting for his life in a flood of blood, to Royapettah Government Hospital. Then as per the doctor’s recommendation, he was taken to Rajiv Gandhi Government Hospital from there, where the Doctor in the emergency ward examined Mani and said that he was already dead. In this regard, F-4 Thousand Lights police have registered a FIR and hence the accused 1 and 2 have committed the offence punishable under Section 302 of IPC r/w Sec.34 of IPC.

The Inspector of Police had filed the final report before the learnedXIV Metropolitan Magistrate, Egmore, Chennai, and he has taken the case on file in P.R.C.No.115/2014 and as the offence under Section 302 of IPC is exclusively triable by the Court of Sessions, the learned Metropolitan Magistrate has committed this case after conducting all formalities under Section 209 of Cr.P.C. to the file of the Learned Principal Judge, City Civil Court, Chennai for Trial.
03. After taking cognizance by the Learned Principal Judge, Chennai inS.C.No.130 of 2015, made over this case to this Court for conducting trial and disposing the case according to law.
04. The accused No.1 and 2 had entered into appearance through their
Counsel and copies of all the documents were furnished to him by the learned Metropolitan Magistrate as per the provision of Section 207 of Cr.P.C. After perusal of the records and after hearing the Counsels appearing for both sides, charge was framed under Section 302 IPC and 302 r/w 34 of IPC against the accused 1 and 2. When the 1st and 2nd accused were questioned as to the charge framed against them, the 1st and 2nd accused had pleaded not guilty and claims to be tried and hence the case was posted for examination of the prosecution side witnesses.
05. On the side of the prosecution PW1 to PW18 witnesses were examinedand Exhibits P1 to P22 documents were marked and Material Objects M.O.1 to M.O.12 were marked. On the side of the 1st accused Dr. Ravikumar was examined as DW1 through him Ex.D1 and Ex.D2 documents were marked.
06. The evidence adduced by the prosecution witnesses are as follows:-
(i) PW1 Mrs.Vasantha, defacto complainant had deposed in her evidence
that, the deceased Mani is her husband and he was working as an acting driver. The 2nd accused Santhanam was doing the business of selling bricks, sand, stones etc. at Thousand lights area and the 1st accused named Kutty @ Manoharan owned a real estate office in front of his shop. Her husband was working as an acting driver for the 1st accused Kutty @ Manoharan and the accused did not pay salary to her husband. On 24.04.2014 at about evening 6.00 p.m., in order to get the money from the 1st accused, the deceased Mani along with his wife went to the office of the 1st accused. There Mani asked his wife to wait outside and he walked inside the office of the accused stating that he is going to collect the money and come. She further deposed that, she saw the accused A-1 and A-2 slapped Mani on his cheeks and pushed him outside from the office. Kutty @ Manohar grabbed her husband’s hair and forcibly hitting his head against the wall and when she shouted aloud the neighbours of the shop named Saravanan, Baskar, a person from the puff’s shop came to the place. Her husband’s brother’s sons named Suresh and Mohan rushed there and took Mani to Royapettah Government Hospital and from there they took him to Government General Hospital. She further deposed that there the doctors stated that her husband was died. In this regard She gave complaint to Thousand lights police station and the complaint is marked as Ex.P-1.
(ii) Mr.Baskar who was examined as PW-2 who turned hostile but he
had identified both accused and deposed that A-1 is running the real estate office at Model School Road and stated that on 24.04.2014 there was dispute at the place of occurrence. Nothing stated about the incident. He was signed when the Police was asked. He was treated as hostile on the side of the prosecution.
(iii) PW3 Mrs.Mannu Bhai had deposed in her evidence that, her
brother in law was working as an acting driver to the accused Kutty @ Manoharan and for work the accused had to give money to her brother in law. She deposed that Kutty @ Manoharan did not give money to her brother in law even after asking several times. She further deposed that on 24.04.2014 at around 6.10 pm when she went to a shop near Kutty @ Manoharan’s office she found people crowded there and she also found Mrs.Vasantha screaming not to beat him. When she asked
Vasantha regarding that she told that about the payment dispute. She deposed that Kutty @ Manoharan grabbed her brother in laws hair and forcibly hitting his head against the wall and he stabbed the upper right jaw of the neck with a car key. At that time, Kutty @ Manoharan screamed “that’s it, you are finished” and his friend accused Santhosh stabbed Mani’s jaw with the Kaapu worn on his hand. She and Vasantha screamed but no one stopped the accused. At that time, a person running the puff’s shop nearby came, the opposite shop owner Santhanam, Telephone shop owner Baskar and Saravanan were there. Blood came from Mani’s mouth and head and blood stains on the wall. She informed her two sons about the incident over phone. Immediately, they came and took Mani to the Royapettah Government
Hospital and for further treatment he was sent to Rajiv Gandhi Government General Hospital. There the doctors stated that Mani was died. She knows the 1st accuse Kutty @ Manohar. She identified the blood stained Kappu and she deposed that the above said Kaapu worn by the 2nd accused Santhosh Gnanakumar at the time of occurrence and the blood stained gold Kaapu is marked as M.O-1. She deposed that the 1st accused Kutty @ Manoharan stabbed her brother in law with that blood stained key at the time of occurrence and identified the blood stained
Key which is marked as M.O-2.
(iv) PW-4 Mr. Suresh deposed in his evidence that, his paternal uncle Mani was working as acting driver in the A1 accused Kutty @ Manoharan. On
24.04.2014 at 6.30pm after receiving a phone call from his mother Mrs.Mannu Bhai PW-3, informed that they are beating his uncle and asked him to come quickly. Therefore, he rushed to the spot immediately and he saw his uncle Mani in blood pool, his right jaw and cheek had a bleeding wound/hole from being stabbed by something. He deposed that he immediately called his brother Mohan, asking him to come. None of the people nearby helped to hold Mani, Santhanam held the feet of Mani and they took him in auto to Royapettah Government Hospital while on the way Mani was unconscious. They took first aid over there and later through ambulance they took Mani to Government General Hospital, there the doctors declared Mani was dead.
(v) PW-5 Mr. Kumar son of the deceased Mani deposed in his evidence
that, his father Mani was working as acting driver. On 24.04.2014 at 6.55pm he received a phone call from his cousin Suresh (PW-4) stating that his father Mani died. When he asked him about what happened to his father, his cousin told that the A1 accused Kutty @ Manoharan had stabbed him and Mani was bleeding from his mouth. His cousin informed him that they took his father Mani to Royapettah
Government Hospital and later for further treatment they took him to government General Hospital, there the doctors declared his father Mani was dead. He further deposed that he got to know the information through Suresh (PW-4) that his father Mani used to drive car as an acting driver for the accused Kutty @ Manoharan and when his father went to ask the money, the A1 accused Kutty @ Manoharan had refused to pay, in this regard dispute arosed on that day, the accused Kutty @
Manoharan stabbed his father Mani with a Scorpio car key and the accused-2 Santhosh Gnanakumar stabbed his father with a bangle (Kaapu). He deposed that when he went to the hospital, he saw his father’s mouth area was torn from being hit by the bangle (Kaapu) and his entire face was covered with blood with a mark from the key stab and it looks like dangerous. He further deposed that when he went to the place of occurrence there was blood dripping on the wall near the entrance of A1 accused Kutty @ Manoharan’s office.
(vi) PW6 Mr.Mohamed Izaath deposed in his evidence that on 24.04.2014 at 9.30 pm he along with Selvakumar was discussing about the incident near Model School Road, at that time police came to the place of occurrence, there was blood stained at the entrance of the A1 accused Kutty @ Manoharan’s office. The police seized the blood stained cement area and blood unstained cement area before them and they both signed as witness in the seizure mahazar. He deposed that the police prepared rough sketch and they both signed it and the observation mahazar is marked as Ex.P-2 and the seizure mahazar is marked as Ex.P-3. The blood stained cement area is marked as M.O-3 and the blood unstained cement area is marked as M.O-4.
(vii) PW-7 Mr.Palani, deposed in his evidence that he is running a puff’s shop in the Model School Road, Thousand Lights next to the 1st accused Kutty @ Manohar’s Real Estate Office. On 24.04.2014 at about 6.00 p.m. in the evening infront of his shop there was noisy and public gathered in the street. He heard that the 1st accused Kutty @ Manohar and one another Mani were stabbed each other.
He deposed that he had not seen the occurrence and turned hostile. ,
(viii) PW.8 Mr.Santhanam deposed in his evidence that He heard that the 1st accused Kutty @ Manohar and one another Mani were quarreled between each other and Mani got injured and he had identified the 1st accused Kutty @ Manohar and turned hostile and has not supported the prosecution case.
(ix) PW-9 Mr.Simal who was examined and he had turned hostile and has not supported the prosecution case.
(x) PW-10 Mr.Muthu Peetharam deposed in his evidence that, on 25.04.2014 when he was working as a Head constable at Thousand Lights police station, Inspector Vijayakumar asked him to go for the post-mortem examination. Based on his instruction, he went to Rajiv Gandhi Government hospital and after the completion of post-mortem of the deceased Mani he handed over the body of the deceased to his son, obtained acknowledgment and reported the same to the inspector. He further deposed that he handed over the internal organs of the body for chemical analysis to the Forensic Science Laboratory, Mylapore. He further handed over the blood stained cloth of the deceased Mani to the Forensic Department. The green coloured, striped, full-sleeve blood stained shirt was marked as M.O-5 and the light cement coloured blood stained pant was marked as M.O-6.
(xi) PW.11 Mr.Kumar he is working as a Junior Engineer, in Tamilnadu Electricity Board, Gopalapuram, in Chennai Corporation. He deposed in his evidence that, on 24.04.2014 the lights were flashing at the place of occurrence from the evening at 5.45.p.m., to till the next day morning. At that time, there was no complaint from the general public that the lights were not “on”. The Inspector of Police given a requisition letter to their office is marked as Ex.P5. In this regard, he had issued a certificate is marked as Ex.P6.
(xii) PW-12 Dr.Rajesh deposed in his evidence that on 24.04.2014 at 7.50 pm while he was on duty at Emergency Ward at Rajiv Gandhi Government Hospital, a person named Mani was brought to the hospital by Suresh through 108 ambulance for emergency treatment. When he asked Suresh regarding the injury he stated that Mani had been assaulted near Model School Road, Thousand Lights. He stated that Mani was initially taken to Royapettah Government Hospital there he was given Accident Register and first aid, later he brought to Rajiv Gandhi Government hospital for further treatment. When he examined Mani he found that he was dead. The information which he gave to the police regarding the death was marked as Ex.P-7.
(xiii) PW13 Mr.Rajaram, deposed in his evidence that he was working as Scientific Expert in the Forensic Science Department. On 29.04.2014 a requisition letter was received by this office bearing number Pi Ne 599/2014 dated 28.04.2014 from the Hon’ble XIV MM, Egmore connected with Thousand Lights Police station in Cr.No.415/2014. He further deposed that the investigative materials relevant to this case was received in their lab on 23.07.2014 as detailed in the Biological Division Report payaal 185/2014. The items mentioned in that report, specifically Item 1 and Item 2, the pieces of cement flooring were analyzed using the Density Gradient method and at the conclusion of the analysis, it was confirmed that Item 1 and Item 2, the pieces of the cement flooring matched with each other. He further deposed that he prepared a report for the analysis in C.H.E.M.209/2014 on 14.07.2014 and was signed by him and his deputy director and the same was sent to the Hon’ble court on 23.07.2014 through registered post. The report was marked as Ex.P-8.
(xiv) PW-14 Mr. D.Parthasarathy deposed in his evidence that as per the
requisition letter from the Director and professor of Forensic Medicine, Madras
Medical College, Chennai he received the viscera (internal organs) related to the
Thousand Lights Police Station in Cr.No.415/2014 with regard to the deceased Mani aged 60 years for chemical analysis and the samples were received on 25.04.2014 through Head constable Mr.Peethambaram. He further deposed that upon performing the analysis, he gave report that “no alcohol or poisonous substances were found”. The Analysis report was sent to the medical officers and the Analysis report was marked as Ex.P-9.
(xv) PW15 Mrs. Rajashri Ragunath deposed in her evidence that on 29.04.2014 while she was working as the Scientific Officer (Biology Division) in the Forensic Sciences Department, Chennai, the case properties related to Thousand Lights Police Station Crime No.415/2014 were received in our laboratory with proper seals. These were received through Mr. Muthu Peethambaram, Head
Constable, as per the letter dated 28.04.2014 from the Hon’ble XIV Metropolitan Magistrate, Egmore. According to the report she provided, blood was detected in the case properties marked as Item 1 and Items 3 to 10. Blood was not detected in Item 2, which consisted of cement plaster pieces. The blood-stained parts of the aforementioned case properties, their item numbers, and the detected blood group were sent to the Serology Division for confirmation. Furthermore, parts of Item 1 and 2 were found to be of the same type and were sent to the Chemistry Division for analysis i.e Item 1 was cement plaster pieces with dark brown stains. Item 2 is cement plaster pieces and the remaining parts of the case properties were numbered on 15/07/2014 and sent to the Hon’ble court. The copy of that letter was marked as Ex.P-10 and the blood analysis report was marked as Ex.P-11.
(xvi) PW.16 Dr. Karthick deposed in his evidence that on 24.04.2014 at 6:50 PM while he was on duty at Government Royapettah General Hospital, a 50year-old man named Mani was brought in by his relative named Suresh. When he enquired about the incident it was told that around 6:15 PM on the same day Mani had been attacked with hands, legs and blade by a known male near the Thousand
Lights Model School Road, sustaining injuries. Upon examination he found that Mani was unconscious. There was swelling on the right side of his face and a cut injury on his jaw area. He further deposed that since he was unconscious, he was given artificial respiration. As per the advice of the surgeon on duty, he was sent to Rajiv Gandhi General Hospital for further treatment. A copy of the Accident Register that he recorded regarding this incident was numbered as 4964763. That copy of the Accident Register was marked as Ex.P-12.
(xvii) PW.17 Dr.S.Angayarkani deposed in her evidence that on 25.04.2014 while she was on duty at Chennai Government Medical College, as per the requisition letter received from the Inspector of Police, F-4 Thousand Lights Police Station, she performed the post-mortem of the deceased Mani. In the postmortem report she certified that the deceased would appear to have died of Head injury. The post-mortem report was marked as Ex.P-13.
The injuries found in the body of the deceased Mani is as follows:
1) Dark reddish brown contusion in both eyelids of right eye swelling and
deformity of right side of face with dark reddish brown contusion 12 x10x0.75 cms in right cheek. On dissection, the underlying soft tissue was contused and the bones were intact.
2) An irregular laceration 1.5 x1x0.5 cms in right side of chin 1.5cm
below right angle of mouth.
3) Dark reddish abrasion (i) 9 x 3 cms in left side of forehead 4.5 cms
above outer aspect of left eyebrow, (ii) 4 x 3 cms in left side of forehead 1cm above outer aspect of left eyebrow, (ii) 3×1 cms in right upper abdomen 30 cms below midclaricular region
4) Dark reddish brown contusion 6x3x0.5 cms in outer aspect of eye7 cms in front of left area.
On dissection of Head: Dark reddish brown scalp contusion, (i) 18×14 cms in right fronto temperoparietal region and (ii) 20 x 16 cms in left fronto temperoparietal region with both tempearalis muscle contusion. Cramial Vault and dura-intact.
Brain – Diffuse subdural and subarachnoid hemorrhages on surface of
both cerebral hemispheres. Dark reddish brown contusion (i) 6x5x1 cms on upper surface of left parietal lobe (ii) 5x4x3 cms on upper and inner surface of right parietal lobe (iii) 5x5x2 cms on outer surface of left temperal lope, base of the skull -intact
On dissection of Neck: All neck structures were normal. Hyoid bone
intact.
On dissection of thearx : Ribs – intact. Heart – normal in size contained
clotted blood. Volves, Coronaries and great vessel – Normal, Lungs – Normal in size, Cut section congested.
On dissection of abdomen: Stomach contained 90ml of dark brown
colored fluid with no specific odour, mucosa – congested liver, spleen and Kidneys – Normal in size. Cut section – congested. Small intestine contained 30 ml of dark brown fluid with no specific odour. Bladder – empty. Pelvis and spinal column intact.
(xviii) PW18 Mr.S.Vijayakumar, Investigation Officer deposed in his
evidence that, while he was on duty 24.04.2014 at F-4 Thousand Lights police station, at 9.00pm as per the complaint given by Mrs.Vasantha (PW-1) he registered FIR in Cr.No.415/2014 for the offences u/s. 302 of IPC. The FIR was marked as Ex.P-14. On the same date, at 9.30 pm he went to the place of occurrence and prepared rough sketch Ex.P-12 and observation mahazar Ex.P-15 in the presence of witnesses Mohammed Ishath (PW-6) and Selvakumar and got signature from the witnesses. He further deposed that he seized the blood stained cement pieces (M.O-3) and the blood unstained cement pieces (M.O-4) at the place of occurrence through seizure mahazar (Ex.P-3) in the presence of the same witnesses and got signature from the witnesses. Further he inquired the witnesses PW-1 to PW-6 and recorded their statements separately. Further he deposed that on 25.04.2014 at 7.00am he conducted inquest on the body of the deceased at the mortuary of Rajiv Gandhi Government General Hospital in the presence of witnesses and panchayatar and he prepared inquest report for the same. The Inquest report is marked as Ex.P-16. Subsequently in order to find the actual cause of death he sent the body for post-mortem through requisition letter via Head Constable Mr.Muthu Peethambaran (PW-10). He further deposed that on 25.04.2014 at 17.00 hours he arrested the A-1 accused Kutty @ Manoharan near Egmore Pantheon
Roundtana, Egmore Eye Hospital gate in the presence of the witnesses Sathanam (PW-8) and Palani (PW-7) then he voluntarily gave confession statement, and he recorded the confession statement of the accused in the presence of the same witnesses. He further deposed that in the confession statement he identified the Scorpio car near the gate and he also agreed to identify the said car’s old key and surrender it. The admissible portion in the confession statement is marked as
Ex.P-17. Further he seized the White colour Scorpio Car bearing number TN07-BJ0711 and its key through seizure mahazar in the presence of the same witnesses. The seizure mahazar is marked as Ex.P-18. The car key is marked as
M.O-6. The photo of the Scorpio Car is marked as M.O-7. Further he deposed that the A-1 accused Kutty @ Manoharan identified the A-2 Santhosh Gnanakumar near
Quaid-E-Millath college bus stop. On 25.04.2014 at 19.00 hours he arrested the
A-2 accused Santhosh Gnanakumar in the presence of witnesses Simon (PW-9) and Subramanian. He further recorded the confession statement of the Accused-2 in the presence of the same witnesses. When he voluntarily gave the confession statement, he stated that Kaapu worn on the hand and the blood-stained clothes worn by the Accused-1 a rose-colored half-sleeved shirt, a grey-colored pant, a blue half-sleeved shirt with white stripes which he was wearing, and the dark cement color pant which he was wearing were all hidden under the mat at the backside of the Scorpio Car and he said that he would surrender the same. The admissible portion in the confession statement is marked as Ex.P-19. The Kaapu was already marked as M.O-1. He further deposed that the blood-stained clothes worn by the Accused-1 a rose-colored half-sleeved shirt was marked as M.O-9, grey-colored pant was marked as M.O-10, blue half-sleeved shirt with white stripes was marked as M.O-11 and the dark cement color pant was marked as M.O-12 was seized through seizure mahazar in the presence of the same witnesses and the seizure mahazar is marked as Ex.P-20. Further he produced both accused before the Court and they were remanded to Judicial custody. Further he deposed that he investigated witnesses Santhanam (PW-8), Palani (PW-7) and Subramanium (PW-9) and recorded their statements separately. Further he sent the case properties to the Court through Form-95. The Form-95 (1 to 4) were marked as Ex.P-21 series. Further he deposed that he sent the case properties viz., M.O-1, M.O-3, M.O-4, M.O-7, M.O-9 to M.O-12 were sent to the Forensic Science Laboratory for analysis along with the requisition letter. The requisition letter was already marked as Ex.P-11. Further he received the post-mortem report from PW-17, investigated her and recorded her statements. The post-mortem report was already marked as
Ex.P-13. Further he received the analysis reports of the seized properties from the Forensic Science Department. The Analysis reports were already marked as Ex.P-9 to Ex.P-11. He further investigated PW-16, PW-12, PW-17, PW-14, PW-15, PW13 each separately and recorded their statements. The requisition letter given by him for conducting the post-mortem is marked as Ex.P-22. Further he deposed that after completing the investigation, on 10.08.2014 he filed charge sheet against both the accused for the offences u/s. 302, 302 r/w 34 of IPC.
07. After examination of PW1 to PW18 the prosecution evidence was
closed by the Additional City Public Prosecutor. When both the accused were examined u/s. 313(1)(b) of Cr.P.C. as incriminating evidence against them and read over to them, they denied the same as false and further stated that they have witness to be examined on their side. On the side of the 1st accused, Dr.Ravikumar examined as DW1 through him Ex.D1 and Ex.D2 documents were marked.
08. Point for determination :-
Whether the prosecution has proved their case against the accused 1 and 2 beyond all reasonable doubt or not, is the question to be decided in this case?
09. Point for consideration:
The learned Additional City Public Prosecutor argued that the
prosecution witnesses PW1 to PW18 and the Investigation Officer and the eye witnesses deceased Mani’s wife PW1 and his brother’s wife Mannubhai PW3, narrated about the above said occurrence was happened and other prosecution witnesses and Doctors’ evidence proved. The charges against both the accused U/s.302 and 302 r/w 34 IPC have been proved beyond all reasonable doubt by producing cogent and convincing evidence and proved the guilt of both the accused beyond reasonable doubt and he prayed the court to found guilty and punish both the accused by awarding maximum punishment.
10. On the contrary, the learned counsel for the 1st accused has argued
that the above said occurrence was not took place and the accused was not involved in the above said offence and the 1st accused is falsely implicated in this case. On the date of occurrence, the 1st accused has got injuries in his eyes and he admitted in the Egmore Eye Hospital. In this regard, he has given a police complaint and registered the FIR No.416/2014 dated 25.04.2014 and the same is marked as Ex.D1. The Doctor, who treated the 1st accused was examined as DW1 through him the Accident Register marked as Ex.D2. Further argued that, there is no progress in the above case.
11. The learned counsel for the 2nd accused has argued that the 2nd
accused name is not found in the complaint as well as in the FIR. The prosecution witnesses PW1 did not depose about 2nd accused. The Accident Register Ex.P12 shows that the deceased Mani allegedly assaulted by one known person. The Doctor PW16 deposed that deceased Mani was attacked by one known person. On comparison of Accident Register and FIR, the 2nd accused did not involve in the offence. PW4 and PW5 hearsay witnesses did not depose about the 2nd accused. PW 7 and PW8 eyewitness turned hostile. There is lot of discrepancies found in the evidence of PW7, PW8 and PW9 in respect of recording the confessional statement of both the accused and the material objects have not been collected in the presence of the accused after recording the same. The prosecution has not proved the charges against the accused. Hence, it is argued that the 2nd accused did not involved in the offence and he prayed to acquit the 2nd accused.
12. Point for consideration:-
According to the prosecution, the deceased Mani was working as an
acting driver with 1st accused Kutty @ Manohar, who is doing Real estate business, having office at Model School Road and he had not paid payment properly and when the deceased Mani demanded wages to the 1st Accused on 24.04.2014 at about 6.15pm the deceased with his wife had gone to the 1st Accused Kutty’s office left his wife outside and asked the 1st accused for arrears of payment, when the 1st accused slapped Mani on his cheek at the entrance of the office, Mani’s wife immediately ran to that side and said “Don’t hit him, he is old man” but the 1st Accused did not listen to her words instead he said ” I wanting for you to get trapped alone, and today you were caught exactly” and also, he hit him on the cheek and grabbed his head by the hair and forcibly hitting his head against the wall of the accused office, and took the Scorpio car key from his pocket and punched the deceased in his jaw and call his friend A2 Santhosh Gnanakumar who was inside his office. Santhosh Gnanakumar who came out and removed the hand protection from his right hand and punched the deceased in the face along with 1st Accused, both of them joined forces and attacked him with loudly saying you die with this, the deceased Mani was bleeding from his head and mouth. The PW-1 with the help of her relatives took her husband, who was fighting for his life in a flood of blood, to Royapettah Government Hospital. Then as per the doctor’s recommendation, he was taken to Rajiv Gandhi Government Hospital from there, where the Doctor in the emergency ward examined Mani and said that he was already dead.
13. The prosecution has examined 4 witnesses as eyewitnesses, who are PW1 Vasantha, PW2 Baskar, PW3 Mannubhai, and Saravanan. The wife of
deceased Mani examined as PW1 and she deposed that her husband was working as an acting driver to the 1st accused Kutty @ Manoharan and the accused did not give payment to her husband. On 24.04.2014 at about evening 6.00 p.m., in order to get the money from the 1st accused, the deceased Mani along with his wife went to the office of the 1st accused. She deposed that, she saw both the accused slapped
Mani on his cheeks and pushed him outside from the office. The 1st accused Kutty
@ Manohar grabbed her husband’s hair and forcibly hitting his head against the wall and when she shouted aloud the neighbours of the shop named Saravanan, Baskar, a person from the puff’s shop came to the place. Her husband’s brother’s sons Suresh and Mohan rushed there and took Mani to Royapettah Government Hospital and from there they took him to Government General Hospital. She further deposed that there the doctors declared that her husband was died. In this regard She gave complaint Ex.P-1.to Thousand lights police station. PW1 is the eye witness, who has seen the occurrence directly. But she has omitted to mention the 2nd accused name in the complaint due to nervousness of the occurrence.
14. On the basis of the complaint, the Investigating Officer PW18
registered the FIR Ex.P14 in Crime No.415/2014 u/s. 302 IPC as against the 1st accused. The 2nd accused name is not found in the complaint as well as in the FIR. The Investigating Officer PW18 took the case on hand for investigation and immediately, went to the occurrence place on 24.04.2014 at about 09.30 .p.m. and visited the occurrence place in the presence of the witnesses Mohamed Izath PW6 and Selvakumar and prepared a observation mahazar Ex.P12 and draft a sketch Ex.P15 in the presence of the above witnesses and he had seized the blood-stained cement area M.O.3 and blood – unstained cement area M.O.4 from the occurrence place in the presence of the above said witnesses. The seizure mahazar is marked as Ex.P3.
15. The deceased brother’s wife PW3 Mannubhai, deposed in her
evidence that, her brother in law was working as an acting driver to the accused
Kutty @ Manoharan and for work the accused had to give money to her brother in law. But Kutty @ Manoharan did not give money to her brother in law even after asking several times. She further deposed that on 24.04.2014 at around 6.10 pm when she went to a shop near Kutty @ Manoharan’s office she found Mrs.Vasantha screaming not to beat him. When she asked Vasantha regarding that she told that about the payment dispute. She deposed that Kutty @ Manoharan grabbed her brother in laws hair and forcibly hitting his head against the wall and he stabbed the upper right jaw of the neck with a car key. At that time, Kutty @ Manoharan screamed “that’s it, you are finished” and his friend accused Santhosh stabbed Mani’s jaw with the Kaapu worn on his hand. She and Vasantha screamed but no one stopped the accused. At that time, a person running the puff’s shop nearby came, the opposite shop owner Santhanam, Telephone shop owner Baskar and Saravanan were there. Blood came from Mani’s mouth and head and blood stains on the wall. She informed her two sons about the incident over phone. Immediately, they came and took Mani to the Royapettah Government Hospital and for further treatment he was sent to Rajiv Gandhi Government General
Hospital. There the doctors stated that Mani was died. She knows the 1st accused Kutty @ Manohar. She identified the blood stained Kappu and she deposed that the above said Kaapu worn by the 2nd accused Santhosh Gnanakumar at the time of occurrence and the blood stained gold Kaapu is marked as M.O-1. She deposed that the 1st accused Kutty @ Manoharan stabbed her brother in law with that blood stained key at the time of occurrence and identified the blood stained Key which is marked as M.O-2.
16. The counsel for the 2nd accused argued that in the Accident Register Ex.P12 shows that the deceased Mani allegedly assaulted by one known person.
The Doctor PW16 deposed that deceased Mani was attacked by one known person. On comparison of Accident Register and FIR, the 2nd accused did not involve in the offence. On the other hand, PW3 Mannubhai seen the occurrence and she is direct eyewitness. Likewise, the complainant PW1 also directly saw the occurrence when the 2nd accused hit the Mani through his Kappu. But, due to shock and nervousness PW1 omitted to mention the name of the 2nd accused in the complaint. The hearsay witness Suresh PW4 only brought the victim Mani to the Hospital and informed the same to the Doctor. He is not eyewitness. Therefore, he omitted to mention howmany persons involved in this occurrence is not fatal to the prosecution.
The counsel for the 1st accused argued that, PW3 was not in the place
occurrence at the time of incident happened and further argued that, PW1 was not deposed about the presence of PW3 in the occurrence place. PW3 Mannubhai is residing in Door No.58, Model School Road, Thousand Light, Chennai, and the occurrence also took place in the office address of the 1st accused at Door No.60, Model School Road, Thousand Lights, Chennai. PW5 Kumar deposed in his cross examination that @ vjpupfs; moj;jij vd; mk;kh ghu;j;Js;shu;/ vd; bgupak;kh kz;qgha[k; bkhli; l khoapy; ,Ue;J rk;gtj;ij neupy; ghu;j;Js;shu;/ @ The PW3’s house and the occurrence place are adjacent. PW3 in her house upstairs she seen the occurrence and immediately she rushed out to the occurrence place and directly seen the occurrence. Therefore, PW3 is the direct eyewitness and her evidence is cogent and she corroborated the incident as per the evidence of PW1.
17. The counsel for the accused objected that both PW1 and PW3 are the
relatives of the deceased Mani hence their evidence could not be reliable and accepted. In this regard, both witnesses deposed that at the time of occurrence, they have shouted neighbour shop owners Saravanan, Baskar, Santhanam, Palani were present and they have seen the occurrence. The eye witness PW2 Baskar, and the confession and seizure witnesses PW7 Palani and PW8 Santhanam,
PW9 Simal, they have identified both accused and deposed that A-1 is running the real estate office at Model School Road and stated that on 24.04.2014 there was dispute at the place of occurrence who are turned hostile. In the presence of them, both the accused did not give confession and case property was not seized. Even though, they have turned hostile, they are narrated that on 24.04.2014 there was a dispute between the 1st accused and the deceased Mani and they fighting each other and public surrounded there. Witness Saravanan was not examined on the side of the prosecution. The case properties Kappu and Scorpio Car Keys are involved in the commission of the offence. That has been seen by PW1 and PW3.
18. The deceased Mani’s son PW 5 Kumar and Mani’s brother’s son PW4 are the hearsay witnesses. The PW3 witness Mannubhai informed the incident to the PW4 Suresh, subsequently he informed the same to the PW5 Kumar. PW4 after getting information, he rushed to the spot and he saw his uncle Mani in a blood pool, his right jaw and cheek had bleeding, wound/hole from being stabbed by something. Immediately, he took Mani in an Auto and went to Royapettah
Government Hospital but Mani was unconscious, later he took him to Rajiv Gandhi Government Hospital, there Doctor declared Mani was died.
Likewise, PW5 Kumar deposed that after getting information that his
father died due to assault of the accused, he went to the hospital, he saw his father’s mouth area was torn from being hit by the bangle (Kaapu) and his entire face was covered with blood with a mark from the key stab and it looks like dangerous. He further deposed that when he went to the place of occurrence there was blood dripping on the wall near the entrance of A1 accused Kutty @ Manoharan’s office.

Eventhough PW4 and PW5 were hearsay witnesses they have cogently
corroborated the incident and took the Mani to the Hospital for the first aid treatment but Doctor revealed that Mani already died.
19. Royapettah Government Hospital, Dr. Karthick PW.16 deposed in
his evidence that on 24.04.2014 at 6:50 PM while he was on duty Mani was brought in by his relative named Suresh, when he enquired about the incident it was told that around 6:15 PM on the same day Mani had been attacked with hands, legs and blade by a known male near the Thousand Lights Model School Road, sustaining injuries. Upon examination he found that Mani was unconscious. There was swelling on the right side of his face and a cut injury on his jaw area, and gave Accident Register Ex.P12 and he was sent to Rajiv Gandhi Hospital for further treatment. On perusal of his evidence, the Mani sustained injuries and swelling on the right side of his face and a cut injury on his jaw area.
20. Rajiv Gandhi Government Hospital, Dr. Rajesh PW-12 deposed in
his evidence that on 24.04.2014 at 7.50 pm while he was on duty at Emergency Ward at a person named Mani was brought to the hospital by Suresh through 108 ambulance for emergency treatment. When he asked Suresh regarding the injury he stated that Mani had been assaulted near Model School Road, Thousand Lights. He stated that Mani was initially taken to Royapettah Government Hospital there he was given Accident Register and first aid, later he brought to Rajiv Gandhi Government hospital for further treatment. When he examined Mani he found that he was dead. The information which he gave to the police regarding the death was marked as Ex.P-7.
21. PW18, Investigation Officer conducted inquest on the body of the
deceased Mani at the mortuary of Rajiv Gandhi Government General Hospital in the presence of witnesses and panchayatar and he prepared inquest report and the same is marked as Ex.P-16. Subsequently in order to find the actual cause of death he sent the body for post-mortem through requisition letter via Head Constable
Mr.Muthu Peethambaran (PW-10).
22. PW17 Doctor Angayarkanni, has conducted postmortem on 25.04.2014 at Chennai Government hospital and noted the several injuries and also collected the viscera from the deceased body and blood stained clothes of deceased and blood stained clothes of the 1st Accused and forwarded them for chemical analysis to the Forensic Sciences Experts PW13, PW14, PW15 and received the Analysis report as Ex.P8, P9, P10, P11 and all they reveals that no poisonous substance found in these viscera and issued the postmortem certificates Ex.P13 and she noted Several injuries on the dead body of Mani, as stated supra, and all these injuries are appears to be found in the vital part of the face and Head Injuries and these injuries are sufficient to cause his death. The PW17 Postmortem Doctor given certificate that the deceased would appear to have died of Head Injury.
23. The blood stained clothes collected from the body of deceased and
the accused shows that human blood was found in Ex.P11. Furthermore, the blood stained cement area collected from the accused office were found the human blood. Due to the integration of the blood coming out from the body might be a reason for not categorizing the blood group and it will not affect the case of the prosecution. During the course of questioning the accused U/s.313(1) (b) of Cr.P.C., this court has categorically explained the incriminating evidence available on record and they denied the same as false and they have not given acceptable explanation in respect of their presence in the scene at the time of occurrence and they did not denied the contention found. The investigation Officer examined as PW18 and he deposed about the investigation.
24. The learned counsel for the 1st accused has argued that the above
said occurrence was not took place and the accused was not involved in the above said offence and the 1st accused is falsely implicated in this case. On the date of occurrence, the 1st accused has got injuries in his eyes and he admitted in the Egmore Eye Hospital. In this regard, he has given a police complaint and registered the FIR No.416/2014 dated 25.04.2014 and the same is marked as Ex.D1. The Doctor, who treated the 1st accused was examined as DW1 through him the Accident Register marked as Ex.D2. Further argued that, there is no progress in the above case. It clearly shows that the incident was took place. There was a quarrel between 1st accused as well as the deceased Mani. Due to that 1st accused got eye injury and taken treatment in eye hospital. FIR also registered. Since the Mani died, there is no progress in the above FIR.
25. From the prosecution evidence available on record shows that the
deceased Mani who was worked as a acting Driver to the 1st accused, and he had not properly paid the payment to Mani, when Mani was asked about the payments, the 1st accused scold him and avoided the payments. On the date of Occurrence, On 24.04.2014, at about 6.00 p.m. the deceased Mani along with his wife PW-1 went to the office of the 1st Accused and asked about the payments, there was a dispute arose between them, immediately the 1st accused stabbed Mani in his hand, and hold his hair and forcibly hitting the head against the wall and he had taken the Scorpio car key from his pocket and hit in the Mani face and 2nd accused also stabbed the Mani through his Kappu. The above incident was directly seen by the PW1 witness, who is a key witness in this case, having provided direct testimony regarding the events leading to Mani’s death, the witness has corroborated with the other witness PW-3 and PW-4, PW-1 confirming that 1st Accused Kutty had a history of threatening Mani. PW-1 testimony is crucial as it establishes the accused’s motive and prior conduct, which is indicative of premeditation and malice intention.
26. The Material Objects (M.O-1 to M.O-12): These material objects
include forensic evidence collected from the crime scene, such as Scorpio car key As M.O.1 and M.O.2 the Kaapu used in the assault, blood-stained clothing of the deceased Mani and 1st Accused and other relevant items. These objects provide tangible proof of the violent nature of the attack and directly link both the accused of the crime. The charge under Section 302 IPC is for murder, which requires the prosecution to prove that the accused committed the act with the intention of causing death or with the knowledge that such an act would likely cause death. The evidence presented, including the testimony of PW-1 and other witnesses and the exhibits, clearly establishes that Kutty @ Manohar/A-1 and Santhosh Gnanakumar/A-2 had the intent and knowledge required under this section. The motive is proved.
27. Based on the evidence presented, including the testimony of PW-1
and other witnesses, the exhibits marked as Ex.P-1 to Ex.P-22, and the material objects (M.O-1 to M.O-12), it is evident that the accused, Kutty@Manohar/A1 and Santhosh Gnanakumar/A2, is guilty of the murder of Mani. The prosecution had established the intent, motive, and direct involvement of both the accused in the offence. From the evidence available on records shows that both accused have brutally attacked the Mani with hands, Scorpio car key and Kaapu and causing
Severe injuries on the face and Head. Due to several Injuries, the mani died. The
PW3, PW4, PW5, were corroborated the same. The Doctor witnesses PW12, PW13, PW14, PW15, PW16, PW17 were corroborated the same. Therefore, the presence of both the accused in the scene of occurrence is proved by the
prosecution beyond all reasonable doubt. In view of the aforesaid, the prosecution has proved the charges levied against both the accused and the charges levied against them is corroborated. Therefore, the considered view of this court is that the nature of death of deceased Mani is homicidal in nature .
28. In view of the above discussions and the reasons given therein, the
presence of both the accused in the seen at that time of occurrence has been proved by the prosecution beyond all reasonable doubt. Therefore, the considered view of this court is that the prosecution has proved the charges against both the accused and this court found guilty U/s.302, 302 r/w 34 IPC and the points are answered accordingly.
29. After finding the guilty of both the accused U/s.302, 302 r/w 34 IPC ,
this court questioned both accused U/s.235(2) of Cr.P.C., with regard to the punishment to be imposed and they replied as follows in Tamil

30. This court carefully considered the above said request of both the
accused. While deciding the quantum of the punishment, the mitigating and the aggravating circumstances has to be taken into account and it appears that there is no previous case or previous conviction found against these accused. Both the accused are not a habitual offender or hardcore criminal endangering the human society. The facts and circumstances of this case is not falls under the category of rarest of rare case. It appears that out of frustration due to the sudden quarrel and depression, they were forced to take extreme step and committing the murder. Therefore this court is inclined to impose maximum punishment on both the accused U/s.302, 302 r/w 34 IPC , and decided this point accordingly.
31. In the result, Both the accused are found guilty under section 302
and 302 r/w 34 of I.P.C., and they were convicted and sentenced to undergo Life imprisonment under section 302 and 302 r/w 34 of I.P.C., and a fine of
Rs.50,000/- imposed on each accused failing which, Two years Rigorous Imprisonment imposed under Section 235(2) of Cr.P.C. It is ordered to deduct the period of imprisonment already undergone by them in the prison, under section 428
of Cr.P.C.,
The material Objects M.O.1 to M.O.12 seized in this case are ordered to
be destroyed after the appeal time is over or if appeal is filed after the disposal of appeal.
