![this appeal stands allowed and the impugned proceeding of the CESTAT in Final Order No.42294/2021, dated 08.09.2021 shall stand set aside and consequently, there shall be a direction to the respondent to refund the amount for which the appellant is entitled pursuant to the demand that arose in Order-in-Original No. 4/2012 dated 30.03.2012, within a period of six weeks from the date of receipt of a copy of this judgment.
