This criminal appeal is allowed and the judgment of conviction and sentence dated 09.11.2023 made in Spl.S.C.No.200 of 2019 passed by the learned Sessions Judge, Special Court for Exclusive Trial of Cases under the POCSO Act, Chengalpattu, is set aside.
2. It is reported by the learned counsel on either side that the appellant is now in incarceration. The appellant/accused is directed to be set at liberty forthwith unless his custody is otherwise required in connection with any other case. Fine amount, if any paid, shall be refunded to the appellant forthwith. Bail bond, if any executed, shall stand cancelled.
