[5/28, 12:16] Sekarreporter 1: [5/28, 12:10] Senior Advt S Prabakaran: As a duty full citizen and duty bounded Member Of Legislative Assembly Mr. Senthilbalaji was organizing camps very neatly with maintaining social distance and was distributing relief items to the general public without any discrimination for all and all the constituency which unused aravakuruchi, kulithalai, karur and another. Repeatedly was requesting the collector to use his MLA funds available for the relief of general public in this COVID-19 pandemic situation, which was not taken to consideration by the district collector, thereafter senthil balaji sought permission from the collector to meet him on 12.05.2020. the permission sought was granted and thereafter Senthilbalaji and others went to meet the collector and there was absolutely no hindrance at all. As a duty bounded MLA he has asked why the welfare measures are not initiated equally to the entire district and there cannot be any discrimination among the public though the constituency has got different party MLA’s, and requested the collector that we are the government servants and we are here to serve the general public and it has to be taken care with utmost effort to come across this situation. The collector replied that he doesn’t require any such advice and he knows what to do, which was indicated by Senthilbalaji in the press meet and he has not caused any harm or alarm, it was anguish as a duty bounded MLA to look after general publics sufferings apart from all discrimination and whatsoever, as pledge we take under constitution to serve the people and that is the only intention that he spoke in the media, otherwise there is no motive attributed or even intended to.
Then the photographs submitted which published in the media also shows that the meeting was invited and the collector was happy in receiving the representation. The submissions of the senior counsel Mr. S. Prabakaran was advanced before the Hon’ble judge. The Hon’ble Court was pleased to ask certain questions about as an administrative head he could have phoned the police to initiate appropriate proceedings immediately if so the ruckus is created?
The the Hon’ble Court was pleased to ask what about the CCTV footage?
For which the learned Public Prosecutor answered that only on that particular day the CCTV was not working so they are not able to furnish the same, this submission of State Public Prosecutor was refuted and the intention of the collector clearly establishes that he has previous motive for the agitation against the collector during elections in the year of 2019 and which made him lodge the present complaint after lapse of 4 long days, when the superintendent of police office is available in the adjacent compound, the submissions were also to the effect that collector failed in his duty in this pandemic situation this made Senthilbalaji to speak in press out of anguish that general public are suffering for agreement made by the collector politically to distribute relief only to the ruling government constituency and the discrimination etc. Otherwise there is no substance or material or intention to make out a crime even as per the prolonged delayed first information report. Further if it seen for a 506(2) complaint in the history it has been transferred to CBCID and the bone behind the transfer of investigation before even local police commence their investigation and it so unlawful and it gives a wrong signal to the establishment of the criminal act. Senior counsel S. Prabakaran submitted that there is no intention to commit any such crime as alleged by the collector and he his a duty bounded MLA representing lakhs and lakhs of people and he has never ever intended to interfere in the administration, in support he has only helped to develop the administration. The Hon’ble high court was pleased to consider the plea and granted Anticipatory bail to Mr. Senthil Balaji and further Mr.V.Senthilbalaji voluntarily agreed to donate a sum of Rs.1 lakh in favour of Cancer Institute, Adyar, Chennai and as usual condition.
