Today OBC case came before SC. The documents filed by Mr. P Wilson was relied by Mr GIRI Senior Counsel for Govt and submitted that to a question raised in the Parliament by Mr TR Baalu, the Health Minister himself has accepted to give state specific reservation in state surrendered seats in All india quota and therefore he pleaded to give state reservations with in this academic year.
ASG appearing for central government informed the court that HC court formed committee’s meeting took place on 22.9.2020 in which issues relating to reservations for year 2021 alone was discussed which was accepted by TN representative and issues relating to percentage of reservation for SC/ ST and OBC was also discussed and since TN has not come back no decision is taken till today .
Mr P . Wilson argued that the judgement of Madras HC is very clear about applying state reservations of 69% which means 50% for OBC. Since the central government is going to release the NEET result on 16.10.2020 without prejudice at least 27% of reservations which central government is implementing in the central educational institutions can be given by the central government in the state surrendered seats to All India Quota and this is only a temporary arrangement till the HC formed committee decides the issue and without prejudice to the rights of parties .
After hearing this submission the bench comprising of Justice L Nageshwarao directed the ASG to get instructions to at least give 27% of reservations in MBBS course this year and has posted the case to 15.10.2020 for hearing.
