ORDER
(Order of the Court was made by M.S.Ramesh.J)
The final e-auction draft notification for Thiruvarur Revenue District in one lot and Coimbatore Revenue District in sixteen lots, produced before us by the Special Officer on 16.12.2025, is ‘APPROVED’ in general, and in particular, the reserve price of the immovable property in Clause 5, subject to the following changes:
(i) Clause 12(q) shall be deleted and the following Clause shall be inserted:
“12(q) The sale certificate will be issued after receipt of the entire sale consideration and confirmation of sale, within 15 days from the date on which the Hon’ble One Man Commission accords approval. The sale certificate will only be issued in the name of the declared successful bidder.”
(ii) In Clause 12(r), the repetition of the words ‘by the’ shall be deleted.
2. The Special Officer shall publish the announcements made in the newspapers, both in Tamil and English, namely Daily Thanthi and The Hindu, every fortnight (15 days), commencing from 30.12.2025, until further orders of this Court. In view of the above approval of the draft e-auction notifications of Thiruvarur and Coimbatore districts, the Special Officer shall publish the notification in the e-auction Online portal, namely tntenders.gov.in., within one week from the date of uploading of this order in the High Court website. Simultaneously, the Special Officer shall also cause wide and extensive publicity for auction sale of the properties through comprehensive advertisements in leading English and Tamil daily newspapers with wide circulation in the area where the properties are situated. Further the same shall be published in the websites designed/to be designed by the Special Officer specifically for the sale of the society. In addition to the same strategic advertisements will be placed on prominent national and regional real estate websites and portals targeting a broad spectrum of potential buyers.
3. The aforesaid approval is granted by this Court as one time measure and the approvals for further e-auction of the properties in other districts or reauction of the present properties in Thiruvarur (one lot) and Coimbatore
(sixteen lots), if any, shall be done, as per the SOP dated 10.10.2025 or Additional SOP dated 12.12.2025, as well as the terms and conditions of the approved e-auction notification.
4. Now, that the proceedings before us has reached the stage of publication of e-auction notification, we hereby summarise, for ready reference, the developments that have taken place during the course of adjudication.
07.04.2025
The Special Officer was called upon to file a list of all members of Kalai Magal Sabha Uruppinargal Pathukappu Sangam; list of all the properties purchased by Kalai Magal Sabha; a soft copy of all the sale deeds / title documents; and the list of properties, where there are encroachments; and the details of the bank accounts in which Rs.112 Crores have been deposited.
24.04.2025
(i) The Special Officer physically appeared before the Bench and reported that the properties of the Sabha were spread over the States of Tamil Nadu and Karnataka, as well as the Union Territory of New Delhi. Since the properties in Tamil Nadu were spread over 33 districts, all the District Collectors of the respective districts were impleaded as party respondents. The Inspector General of Registration was called upon to share the details of the properties to each and every District Collector and the District Collectors, in turn were directed to inspect the properties with the help of the Tahsildar / Surveyors.
(ii) Since there was a possibility of change over in the Roster and that the counsel for the petitioner, as well as the Government Pleaders made a request to the Bench to continue hearing of the case, their request was recorded and placed before the Hon’ble Chief Justice.
(iii) The Hon’ble Chief Justice was pleased to order this particular Writ
Appeal No.472 of 2024, to continue to be heard by the same Bench (MSRJ & NSJ), through an order dated 23.06.2025.
29.04.2025
No significant adjudication.
18.07.2025
(i) Pursuant to the orders of the Hon’ble Chief Justice, the Writ Appeal was listed before the Special Bench. It was reported that the Special Officer had circulated a letter dated 16.05.2025, which appeared to be a press release, calling upon the depositors / subscribers to approach him for receiving their deposit amounts.
(ii) We had frowned upon this conduct and refrained the Special Officer from taking any course of action based on the press release.
01.08.2025
The Special Officer reported that they had stopped all further proceedings, pursuant to the press release, dated 16.05.2025. When the District
Collectors failed to submit their reports, we had directed the Additional Chief Secretary to Government, Revenue and Disaster Management Department to physically appear before this Court, along with the Status Reports of all 33 District Collectors.
08.08.2025
(i) The status reports of the District Collectors of 9 districts were filed before us. The learned Additional Advocate General undertook to expedite the process and file the status report for the remaining 26 districts. The learned Advocate General produced a copy of the Contempt Petition No.153 of 2023 and a batch of Writ Petitions, which had prompted the Special Officer to give the press release dated 16.05.2025. The Advocate General undertook that the status of the subscribers would not be dislodged, in view of the press release or any amount that may have been repaid to them.
(ii) The adverse remarks made on 01.08.2025 against the Special Officer was expunged ands his conduct was condoned.
22.08.2025
Seven District Collectors had filed their status reports and further time was granted for the other District Collectors. The Special Officer was called upon to submit two consolidated statements of the properties of the Sabha, one with encroachments and other without encroachments, along with the details.
12.09.2025
The status reports of the four District Collectors were filed, which we had recorded to be as an interim report. One last opportunity was granted to the remaining District Collectors to file their status report.
19.09.2025
(i) Twenty District Collectors filed their status reports. Madurai District
Collector sought for further time. The status report of Coimbatore District Collector was treated as an interim report.
(ii) Since it was reported that the Sabha owned properties in the Union Territory of Puducherry, they were impleaded as the 87th respondent in the Appeal.
25.09.2025
(i) Fourteen District Collectors filed two separate list of properties, with and without encroachments. The other District Collectors sought further time for filing their reports.
(ii) The Special Officer sought further time to report on the status of properties with litigations.
(iii) We expressed to bring the properties, without encroachment for public e-auction and the Special Officer was called upon to submit the SOP for the auction, as well as for removal of encroachments.
(iv) The Special Officer’s report of having communicated to 155 Sub
Registrars in the State to mark the properties of the Sabha as “Prohibited Properties” was recorded.
(v) The Judicial Officers of all the districts were directed to refrain from entertaining any Civil Suits against the properties of the Sabha. The Revenue Secretary of Puducherry was called upon to file their report.
10.10.2025
The direction to the District Judiciary to refrain from entertaining any Civil Suits was modified by inserting a Clause, ‘(unless leave of this Court is obtained)’. For the purpose of ascertaining the market value, a Special Committee, including two Professional Valuers was formed. The list of pending cases against Sabha’s properties was produced. The remaining 8 status reports of the District Collectors were directed to be filed in the next hearing.
17.10.2025
Thirty One District Collectors had filed their reports. The process of valuing the properties was recorded.
31.10.2025
The Inspector General of Registration, Puducherry was directed to record all the properties of the Sabha and the learned Chief Judge, Puducherry was called upon to instruct all the Civil Courts to refrain from entertaining any Civil Suits over the properties of Sabha, unless the leave of this Court is obtained.
06.11.2025
The Sub Committee for valuation of the properties was directed to concentrate on the properties in their districts of Coimbatore and Thiruvarur. The learned Government Pleader, Puducherry filed his report with details of 37 properties of the Sabha.
07.11.2025
Further time was granted for completing the valuation. The list of subscribers of the Sabha was ordered to be uploaded in the website in a chronological manner.
19.11.2025
Interim Valuation Report for 12 items of properties were received and the draft notification for the proposed e-auction was also received and certain corrections were ordered to be carried out.
28.11.2025
The details of the members of the Sabha was uploaded in Alphabetical order. The draft notification for e-auction of six sample properties in Coimbatore District was received. The Special Officer was directed to produce mapping of the contiguous properties. The learned Government Pleader,
Puducherry filed his valuation report of one property, without encumbrance. Certain corrections to the draft notification was suggested. The Special Officer had offered to bring a technical person to administer the accessibility of their website. The learned Government Pleader, Puducherry reported that the two properties, without encumbrance, was wrongly reported and that even these properties have encumbrances.
09.12.2025
Hon’ble Mr.Justice S.S.Sundar (Rtd.) was requested to act as One Man Commission and two Advocates Ms.M.Ezhilarasi and Mrs.N.Premalatha were appointed to assist him. Several revisions to the draft notification were suggested by the Bench.
11.12.2025
(i) Five further modifications to the draft notification was suggested.
(ii) Further time for filing of the draft SOP and draft newspaper advertisement was granted.
12.12.2025
The SOP dated 10.10.2025 and Additional SOP dated 12.12.2025 were recorded. So also, the e-auction draft notification. Final draft notification was sought for the properties in Coimbatore District and Thiruvarur District.
16.12.2025
The publication of the newspaper announcements in the Hindu and Daily
Thanthi dated 15.12.2025 was recorded. Thiru.Dinesh Ponraj Oliver, the present Special Officer was directed to be appointed as the permanent Special Officer, until further orders of this Court.
