ORDER
(Order of the Court was made by the Hon’ble M.S.Ramesh J.)
The District Collectors of Madurai and Coimbatore have now given their respective status reports with regard to the survey conducted in the properties standing in the name of Kalaimagal Sabha.
2.To our specific direction for the District Collectors to file two separate lists of properties, namely, those with encroachments and without encroachments, the District Collectors of Virudhunagar, Tiruvannamalai, Madurai, Chengalpet, Tirupathur, Dharmapuri, Ranipet, Coimbatore, Perambalur, Kalakurichi, Namakkal, Tiruvalur, Krishnagiri and Cuddalore, totaling 14 districts, have submitted their reports.
3.Learned Additional Advocate General appearing for respondents 49 to 81, seeks further time for filing the reports of the other District Collectors.
4.Mr.B.Vijay, learned Standing Counsel for the Kalaimagal Sabha, brought to our notice about several civil suits and appeals, which are pending across the State in connection with the properties of Kalaimagal Sabha. He seeks for further time to update the status of the said cases from the e-portal.
5.As a first measure in dealing with the properties of Kalaimagal Sabha, we intend to bring all the properties, which are free from encroachment, for public e-auction.
6.The Special Officer is called upon to submit a Standard Operating Procedure (SOP), setting forth the mode in which the public auction may be conducted.
7.Another SOP shall be prepared by the Additional Advocate General representing all the District Collectors, with regard to the mode, in which the encroachments may be removed, under various encroachment laws.
8.In the status report filed on 12.03.2025 by the Special Officer, it has been stated, inter alia, that communications have been sent to around 155 Sub Registrars in the State to make a note in the Index II, relating to the properties of the Sabha as “prohibited properties”. The Special Officer, who is present before us today, confirms that such notings have also been carried out by these concerned Sub Registrars.
9.Since the proposed auction requires to be conducted and completed without any hindrance or other disturbances, and by taking into account that these properties pertain to the interest of about 6,50,000 members, we are inclined to pass the following specific
order:
“All the Principal District Judges / District Judges and the Chief Judge, Puducherry, shall forthwith communicate to the Civil Courts under their jurisdiction to refrain from entertaining any Civil Suits by any person against the properties belonging to Kalaimagal Sabha, morefully described under the
schedule.”
10.The Registrar (Judicial) shall forthwith issue a circular to all the Principal District Judges, including the Chief Judge, Puducherry, communicating this portion of the order in Paragraph 9 above, enclosing the schedule of properties of that respective districts, which are part of the records. It is hereby clarified that the circular addressed to the Principal District Judge / District Judge / Chief Judge, Puducherry shall also be appended by the schedule of properties situated within the territorial limits of that particular district alone and the properties of the other districts need not form part of the schedule. Since the list of properties in all the 33 districts of Tamil Nadu are voluminous, the Registrar (Judicial) is at liberty to access the details of properties of Kalaimagal Sabha, in each and every district of Tamil Nadu, which details have been stored in a pen drive and forming a part of the records in this Writ Appeal.
11.Mr.Krishna Mohan Uppu, I.A.S, Revenue Secretary, Puducherry is also called upon to survey all the properties standing in the name of Kalaimagal Sabha, within their Union Territory and submit a report, which shall contain the entire details of the properties, including its physical features. The report shall also mention as to whether there is any encroachment in the property in question. The Special Officer / IG of
Registrar shall share the details of the property within the territorial jurisdiction of UT of Puducherry, as and when such a requisition is made by the Revenue Secretary, Puducherry.
