Today the Hon’ble Supreme Court of India bench comprising Hon’ble Mr. Justice Manoj Mishra and Hon’ble Mr. Justice Joymalya Bagchi heard the SLP against the dismissal of anticipatory bail petition filed by MLA Mr. Jagan Moorthy before the Hon’ble High Court of Madras.

Learned Senior Counsel Mr. S. Prabhakaran and Learned Counsel Mr. Muthu Charan appearing on behalf of the Petitioner Mr. Jagan Moorthy, submitted to the court that, after the interim protection granted by the Hon’ble Supreme Court, the Petitioner(Mr. Jagan Moorthy) was called for investigation twice and pursuant to the order of the Hon’ble court, the Petitioner appeared before the investigation officer twice and cooperated with the said investigation.

It was further submitted by the Senior Counsel and Counsel that the Interim order granted by the court may be made absolute as the substantial part of the investigation is complete.

On the other hand, learned Additional Advocate General(AAG) Mr. Anand Tiwari, appearing on behalf of the respondent vehemently opposed the plea of bail and submitted that it is a matter where there are serious offences of abduction and attempt to murder. It was submitted by the AAG that, this petitioner has been continuously indulging himself in conducting Kangaroo Courts, out of court settlements and other illegal activities in this manner. Learned AAG also contended that there are many other similar instances where the petitioner has acted in the same manner.

Subsequent to hearing both the Learned Senior Counsels appearing on either sides, the Hon’ble Supreme Court has allowed the SLP and made an oral remark that when political malafide is taken as defence it has to be considered and had made the Interim order of protection absolute and has granted Anticipatory Bail to the MLA, Mr. Jagan Moorthy in the abduction case. The Hon’ble Court further commented that settling issues between parties by an individual, especially when the case itself is being compromised between the parties cannot be given a criminal colour.
