HC upholds order granting relief to siddha practitioner

Madurai: Madras high court has upheld the order passed by a single bench, directing the state govt to appoint a differently abled siddha medical practitioner belonging to the scheduled caste community to the post of assistant medical officer (siddha).

Dr P Palavesakumar, who completed an MD (siddha) degree, applied for the post of assistant medical officer (siddha) in response to the notification issued in 2017 by the Medical Services Recruitment Board. He obtained 57 marks out of 100 in the written examination. However, he was not selected. Challenging the provisional selection list, the petitioner filed a petition before the HC Madurai bench in 2017. Since the petitioner restricted his relief during the final hearing of the case, the court disposed of the petition in 2019 with a direction to the authorities to consider his claim subject to the availability of a vacancy.
However, his request was rejected by the authorities, stating that the selection was properly done. Challenging the rejection order and the provisional selection list, the petitioner filed the present petition in 2020.
The single bench had observed that a mere look at the selection list showed that the meritorious scheduled caste candidates, instead of being appointed in open category vacancies, were appointed in reserved vacancies.

The court did not find any infirmity in the order passed by the single bench, the judges observed, and dismissed the appeal.
