d out without proper jurisdiction and in violation of the procedural safeguards under the Prevention of Money Laundering Act, 2002.
On the previous hearing, dated 23.07.2025, the Hon’ble Court had taken serious note of the Enforcement Directorate (ED) violating the interim stay order dated 20.06.2025, which had restrained further proceedings under the impugned authorization. Despite being fully aware of the stay, the ED had issued a show cause notice, which the Court found in direct contravention of its orders.
The Hon’ble court had granted a final opportunity to the ED Department to withdraw the said notice and file a counter affidavit before 06.08.2025. It was explicitly made clear that any further violation or delay would not be tolerated.
Again on 06.08.2025 The ED Department, instead of complying with the court’s directions, sought a further extension of two weeks to file its counter. The Hon’ble Court was visibly displeased. It also criticised the manner in which the ED had attempted to withdraw the impugned notice. It was also not satisfied with the way the notice withdrawal was communicated via email, calling it needlessly complicated and non-compliant with the earlier bench direction.
As a result, the court imposed cost of ₹10,000 per writ petition, totalling ₹30,000, on the ED Department. The court made it clear that no further time will be granted and directed the counter affidavit to be filed before 20.08.2025.
