[6/29, 16:53] Sekarreporter: Today the Division Bench of Hon’ble High Court of Madras led by Hon’ble Chief Justice heard a matter in seeking change of inquiry officer in an inquiry proceedings being conducted against a judicial officer. The Hon’ble High Court heard the arguments of learned Senior Counsel Mr S Prabakaran for the petitioner/ judicial officer and learned counsel Karthik Ranganathan appeared for the Registrar General of the High Court and for the presiding officer of the inquiry. Learned Senior Counsel Mr S Prabakaran submitted to the court that the presiding officer is proceeding with a personal bias against the petitioner. The learned senior counsel Mr Prabakaran further cited different instances of happenings in the proceedings to justify the apprehension of bias in the minds of the petitioner. The learned senior counsel Mr Prabakaran relied and substantiated his arguments on principles of Natural Justice and prayed for a fair hearing and further suggested for a in camera proceedings. The learned counsel for the respondents however opposed the allegations and filled a detailed counter disputing the allegations of bias. The Hon’ble Court considering the submissions made on both the sides directed the proceedings to be videographed in interest of justice and directed the registrar to maintain the video recordings till the end of the proceedings and further observed that the concerned parties to act according to their stature and any deviations to the same will be viewed seriously. The Hon’ble High Court with above directions disposed the writ petition.
