[6/29, 22:33] Sekarreporter 1: Initially a complaint has been lodged by advocates LOGANATHAN and Sasikala for an incident that took place while they were on cue for water, tamilamuadan had prior motive against the advocates who is in the field of real estate and used purchase properties using his clout and muscle power, these two advocates having own residence in a apartment situate at Guduvancherry and their only apartment was left over because the said tamilamuadan purchased all other flats by chasing others one or the other. The said tamilamuadan made several attempts to evict these two advocates on various occassions which he failed, on the date of occurance the said tamilamudans mother had a wordy quarell with these two advocates followed by a serious life threat given by Tamil amudan hiring local goons and for the incident the advocates lodged a police complaint and an FIR has been registered against tamilamudan and others. The next day when the inquiry was going on the said Tamil amudhan lodged a false and counter complaint against advocates LOGANATHAN and Sasikala practising at Madras High court, alleging as if his mother was pushed and due to that she died subsequently at hospital in the month August after lapse of one month later the incident. Charge sheet has been filed by the police against these two advocates and the same has been challenged by way of the present quash petition, the Honble court perused the entire records and the way in and which the charges levelled, senior counsel Mr. S. Prabakaran submitted that the cause of death has been very clearly found in the discharge summary that she died because of brain tumor and according to medical jurisprudence and law the case foisted is unsustainable and need to quashed and the allegations are baseless and it is deemed to be quashed and prosecution if let to proceed it won’t secure the ends of justice and on perusal of the entire records and reason the charges sheet filed against the petitiners LOGANATHAN and Sasikala has been quashed by Honble Mr. Justice Ilanthiryan by upholding justice.
