[9/9, 18:34] Sekarreporter 1: A Public Interest Litigation filed by S.Saranya regarding regulation of online education during covid-19 situation came up before the Hon’ble Judges Hon’ble Mr.Justice M M Sundresh and Hon’ble Mrs. Justice R Hemalatha of the Madras High Court for final orders today. After hearing all the respective parties and the stakeholders patiently, The Hon’ble Judges have passed a detailed order in considering the paramount importance of the welfare of the childrens. In the orders the hon’ble judges appreciated and recorded the excellent assistance rendered by all the counsels starting from the first petitioner for which Learned Senior Counsel S.Prabakaran appeared and ending with Additional Solicitor General of India and Additional Advocate General, inclusive of learned counsel appearing for institution.The hon’ble judges observed many problems regarding the implementation of online classes namely the usage of technology and important factors of social divide, varied curriculum, methodology and facilities.The hon’ble judges have highlighted the important aspects of the guidelines while concentrated on the main issues which was raised before the judges.
The hon’ble judges have issued important directions to the State Government and to the Schools and all other stakeholders
1. To treat the guidelines issued by the Central and State as mandatory and to be followed by all the stakeholders.
2. The timelimit for the online classes should be strictly adhered by the guidelines any voilation the concerned authorities are allowed to take action
3. The State of Tamil Nadu and other bodies with whom schools are affiliated shall issue circulars to the schools for the measure required to be taken for blocking obscene content.
4. Progarams conducted to be sent by whatsapp to the parents and uploaded in the school website.
5. Directing the State Government to set up committees in all districts to ensure proper implementation of the guidelines.
6. The concerned schools to identify the problems being faced by parents and teachers in online connectivity.
7. Group of students can be allowed to attend physical classes while following social distance in small groups.
8. Schools to explore the possiblity of teachers going to students and giving education if facility exist.
9. The guidelines issued in respect to the attendance,test and examination to be strictly complied by the schools.
10. Guidelines with respect to pre primary to be strictly complied.
11. The schools to explore possiblity of having end to end encryption.
12. The guidelines issued by the State to be translated in Tamil.
13. Maintain regular interaction between parents and teachers regarding online learning.
14. To address any complaints given to the helpline and to be immediately addressed by the cyber crime cell.
The Learned Senior Cousel S.Prabakaran raised the issue of pop redirects of explicit content , The hon’ble Judges directed the State Government namely the Secretary to the Government, Department of Education, Fort St George to deal with the said issue and the court also suggested of having a blocker as solution to these problems.
