14-3-21 Mahaveer Shivaji MHC advocate: PART II CITIZENSHIP CONTINUES: The recent amendment pertaining to CITIZENSHIP ACT 1955 was made by Indian parliament by way CAA 2019. by this certain Article was inserted in 2(1)b, 3(2)c,6B,7(da),(f) .all these have centered around 6 religion and except 3 countries (Afghanistan, Pakistan, Bangladesh) ,in which MUSLIMS excluded.that is the Muslim are prohibited to get Citizenship of India from those three countries.if rest of the 6 religious persons entered into India on or before 31-13-2014 shall not be treated as illegal migrants.instead they are given Citizen of India by registration or by naturalisation and their pending proceedings shall be abated.Further it shall not applicable to tribal areas in 6th schedule of the constitution.further there is NPR yet to be implemented throughout India, which is already in Assam. This differenciation was also already been made when PIOs and OICs given Citizenship and dual citizenship, but in those amendment there is no religious discrimination but the CAA having religious discrimination, that alone invited large scale agitation against such amendment. But now the matter pending with SC and refusal of granding interim order to CAA shall proceed with implementation which itself shall defeat the purpose of Constitutional challenge to CAA………….. TAIL END NEWS IN CURRENT SCENARIO…….. question expecting reply: if a person not belong to any of the caste or the particular community doesn’t have caste system, then such person shall be eligible to contest in reserved constituency or not?
