11-2-21: mahaveer shivaji MHC advocate: PART I continues: In India the states were created for the administrative purposes by the union and union political movement alone liberated India from British regime.that is the reason Indian Constitution contains only federal features not true federal Constitution. The formation of linguistics states is novel Idea to maintain its own identity and preserve the same. The Part I of constitution confered power on union government to use the name of India as BHARAT or it also called as CONSTITUTION OF BHARAT or REPUBLIC OF BHARAT without making any amendments. The territory of India includes territory belongs to States and union territory and also territory upto 20nautical miles in sea water, till such territorial boundaries Indian sovereignty extends. In the HIGH SEA OR OPEN SEA the entire area belongs to world countries other than EEZ upto to 200 nautical miles the adjusent country shall have power to oxplore and exploits its resources But not possess any sovereign power. The states in India shall survive at the mercy of union because the union government shall have the exclusive power to alter the states boundaries for the purpose of creating new states, for abolishing existing states, delimitation of territorial boundaries of existing states for the purpose of merging of states. but it should be done with parliament procedure not by executive order. The constitutional procedure is that: (1) the introduction of Bill in parliament only with prior recommendations of president and such recommendation doesn’t mean that the president given his consent to the Bill for reorganization of states………….. The election commission must give atleast 3 days for the voters so as to make 100 percent poll results by Increasing one hour is sufficient.The Election Commission gives number of days for filling nomination, for withdrawal of nomination and for counting of votes and also for election campaign.
