THE MARKED DIFFERENCE BETWEEN LAW AND JUSTICE
Law and Justice are strongly connected with each other, but
they do not connote the same meaning. Justice is a broad concept which
encompasses equality of rights, fairness, ethics and morality. Conversely, law
is a body of regulations and standards set up by a ruler or government or
authority and enforced in a society. Law, which is used to regulate and
control the actions of citizens, is expected to be based on the idea of Justice.
Justice is often depicted as a blindfold woman – representing equality and
fairness and thus applying laws and regulations to all individuals without
discrimination.

This is clear in view of how Thiruvalluvar has dealt with it in
mwj;Jg;ghy; [on virtue] and bghUl;ghy;[on wealth]. In dealing with “killing”,
Thiruvalluvar counsels avoidance of killing in mwj;Jg;ghy; whereas rationalizes
imposing the extreme penalty of death sentence for a brutal murderer, as a
trait for a king who follows just rule, in bghUl;ghy;/

In some cases, we as Judges also face similar dilemmas where
we feel that a judgment purely based on the letter of law does not really
meet the requirements of a particular case. Therefore, we consciously
attempt to read into that law “Justice”. That is how the march of law keeps
happening. If we lose this sense of Justice, a day will come when robots will
replace Judges.
