The petitioner herein was given lease for stone quarry on 13.01.2016 for a period of five years in respect of his patta land measuring an extent of 1.09.0 hectare situated in Survey Nos. 96/1B and 96/2B, Morattupalayam Village, Uthukuli Taluk, Tiruppur District. According to the petitioner, during the subsistence of lease period, the District Collector, Thirupur passed the order dated 25.01.2021 cancelling the stone quarry lease issued to him for alleged violation of the conditions of the lease. Challenging the order dated 25.01.2021, the petitioner has come up with this writ petition.
- When the writ petition was taken up for hearing on 03.08.2021, it was brought to the notice of this Court by the counsel for the petitioner that several stone quarries have been operating in the area without license and following the conditions of lease, however, the petitioner alone was discriminated. In the light of such submission of the counsel for the petitioner, this Court thought it fit to undertake a comprehensive survey of all the stone quarries operating in the said area and to bring to book the violation, if any. For such purpose, this Court appointed Mr. V. Ashok Kumar, Advocate as an Advocate Commissioner to inspect all the stone quarries operating in the area concerned with the help of the officials, after issuing due notice to all the parties.
- Accordingly, the Advocate Commissioner appointed by this Court has inspected the quarries in Uthukuli Taluk on 09.08.2021, 10.08.2021, 14.08.2021 and 15.08.2021, based on which he has filed a comprehensive report dated 17.08.2021. The report contains shocking revelations about the illegal stone quarries being operated in the area and they have illegally been permitted by the authorities all these years. As per the report of the Advocate Commissioner, there are 64 stone Quarries which are being operated without any licence or lease. Further, the report unfolds that out of the 24 licenced quarries, 18 quarries were inspected and all the lease holders have violated the conditions of lease in one way or the other and indulged in quarrying the land beyond the permissible limits. The Advocate Commissioner has also enclosed photographs of licensed and non-licensed quarries to show the nature and extent of violations perpetrated by the stone quarry operators. The advocate commissioner has also stated in his report that he found two lorries running in the very same registration Number viz., TN 55 Z 7753. Thus, the report of the advocate commissioner had blown the lid off as to how stone quarrying is being operated without even any licence or lease and thereby causing loss of thousands of crores of rupees to the exchequer besides environmental loss to the State. The report also reveals the apathy of the administration in not causing any inspection, much less periodical inspection, of the quarrying activities in the area, which had embolden the violators to indulge in quarrying activities without any lease or licence. The report of the Advocate Commissioner had pointed out the violations committed by the licenced stone quarry owners as well as the non-licenced stone quarry owners. - Taking note of the magnitude of the violations of stone quarrying lease, as pointed out by the Advocate Commissioner, mentioned above, this Court is passing the following orders:-
(i) The District Collector, Thiruppur is directed to forthwith close all the 64 un-licenced quarries pointed out by the Advocate Commissioner in his report, as mentioned above and to ensure that no further quarrying takes place in those sites.
(ii) The District Collector, Thiruppur is further directed to initiate criminal action against those who operated the 64 un-licenced quarries as well as those who are instrumental in allowing such un-licenced quarries to operate such as Village Administrative Officer/Tahsildar/Revenue Divisional Officer/District Revenue Officer and other officials concerned, besides initiating appropriate proceedings to recover the loss caused to the exchequer due to such illegal stone quarrying
(iii) The District Collector, Thiruppur is also directed to issue show cause notice (s) to the licenced stone quarry operators for the violations pointed out by the Advocate Commissioner and to proceed further in accordance with law.
(iv) The Regional Transport Officer of the District is directed to seize all the vehicles having same registration number, particularly, the vehicle bearing Registration No. TN 55 Z 7753 and to initiate proceedings for confiscation of the vehicle (s).
(v) The District Collector, Thiruppur is directed to file a compliance report before this Court on or before 06.09.2021. Post this Writ Petition for further hearing on 07.09.2021.
