Pursuant to the earlier orders passed by this Court on 08.04.2022, the matter was posted for hearing today to report the follow up action on the directions issued by this Court during the previous hearing.
National Medical Commission
2.The learned Standing Counsel appearing on behalf of the National Medical
Commission (NMC) was directed to follow up on two issues, viz.,
a) To report on the modified competency and inform this Court as to whether it has been incorporated in the relevant books and materials to be supplied for students undergoing the medical course. The learned Standing Counsel shall also take specific instructions on the subjects in which the modified competencies is going to be implemented.
(b) This Court directed the NMC to issue necessary official notification by enlisting “Conversion Therapy” as a professional misconduct. However, the communication received from NMC shows that draft Conduct Regulations 2022, has been put in the public domain and the NMC has invited suggestions. While going through the draft, it is seen that only the gender based discrimination has been included as a mis conduct. However, the “Conversion Therapy” that was directed to be enlisted as a professional misconduct pursuant to the recommendations made by Committee, is conspicuously absent. The learned Standing Counsel shall take
specific instructions in this regard.
NCERT MANUAL
3.The learned Senior Panel Counsel submitted a Status Report and for easy understanding, the same is extracted hereunder :-
As discussed with Prof. Jyotsna Tiwari the first draft of the module titled Training Module on Integrating Transgender Concerns in Schooling Process’ which is based on the earlier training material Inclusion of Transgender Children in School Education: Concerns and Roadmap’ has been developed in consultation with different stakeholders. The module has been developed in order to sensitize the whole school environment regarding Transgender persons and children through different interventions. The same is being formatted and will be shared with all committee members for any comments and thereafter with all states, CBSE, KVS and NVS for their comments and suggestions in August, 2022. It will be shared with all stakeholders by second half of August, 2022. Also it will be uploaded on the NCERT Website and notification will be sent to all the states, CBSE, KVS, NVS etc. to conduct training for sensitization of different stakeholders of school education in the coming academic session.
4.The Senior Panel Counsel submitted that time lines have been fixed by NCERT and conducting training for sensitization of different stake holders of school education will start from the forth coming academic session.
ENLISTING NGOs
5.A Status Report has been filed by the 10th respondent. It is seen from the Status Report that an advertisement has been released by the 10th respondent calling for applications from NGOs / CBOs to enlist themselves under the Garima Greh Scheme. The learned Senior Panel Counsel submitted that already 70 applications have been received and it is in the process of finalization.
6.The earlier directions issued by this Court on 08.04.2022 at para 17 did not confine itself to the NGOs, who are interested in enrolling themselves under the Garima Greh Scheme. It also includes NGOs, who are working for the welfare of the persons belonging to the LGBTQ+ community. These NGOs need not necessarily come within the fold of Garima Greh Scheme. Hence, the learned Senior Panel Counsel is directed to inform the 10th respondent, to take steps to independently enlist the NGOs, who are working for the welfare of the persons belong to LGBTQ+ community and who are not enlisting themselves under the Garima Greh Scheme
Tamil Nadu State Legal Services Authority
7.The Standing Counsel appearing on behalf of the Tamil Nadu State Legal
Services Authority sought for some more time to file a report on the ground that the Member Secretary of the Tamil Nadu State Legal Services Authority has been transferred and a new incumbent has taken over office very recently.

8.The learned Additional Advocate General submitted that he requires some time to take instructions and report before this Court the progress made after the earlier order was passed by this Court on 08.04.2022.
9.The learned counsel for the petitioner submitted notes of submissions along with typed set of papers. Various suggestions have been given about the conversion practices and the scope of prohibition of the conversion practices. Reference has also been made to the Legislation that is available in two other countries in this regard and also to the United Nations report of the Independent Expert on protection against violence and discrimination based on sexual orientation and gender identity.
10.The learned Standing Counsel for National Medical Commission, shall also take note of the suggestions given in the notes of submissions and it can be made use of by the National Medical Commission,while finalising the enlistment of the professional misconduct for “Conversion Therapy”.
11.Post this writ petition for hearing on 25.07.2022 at 2.15 p.m.
