When the matter was heard on 25.02.2022, and today the learned

for the petitioner, who gained reputation in the Bar, made a strong statement that the transfer and posting through counselling are made only based on corrupt activities.  It was further submitted before this Court that for transfer and posting to a particular place or post, the Teachers are paying a sum of Rs.10,00,000/- (Rupees Ten Lakhs only) and more as bribe.  Similar such statements were made by other counsels and more so, such statements are frequently made before this Court in the cases of transfer and posting. Today also, the learned counsel for the petitioner reiterated his earlier submissions.

2.This Court is of the considered opinion that if the transfer and

posting are auctioned like IPL Cricket Players, then the stand of the Government must be clarified before this Court in the interest of justice and in the interest of educational system.  If there is an allegation that the Teachers are paying Rs.10,00,000/- or more as corruption for getting posting, one can form an opinion, what sort of education they will impart to the children in schools and what kind of moral and discipline they will teach to the children.  The situation is undoubtedly a worrying factor and if it continues, it will lead to disastrous consequences.  Probably, the Head of the Department and the Principal Secretary are not concentrating on Southern Districts, where such things are allegedly happening very commonly, as per the learned counsels.

3.In view of such strong allegations made across the Bar by the

responsible learned counsels appearing before this Court, this Court is inclined to suo motu implead the Director of Vigilance and Anti-Corruption, Directorate of Vigilance and Anti-Corruption, Collectors Nagar, Alandur, Chennai-600 016 as the 7th respondent. 

4.Mr.G.V.Vairam Santhosh, learned Additional Government Pleader takes notice for respondents 1 to 5; Mr.Henri Tiphange, learned counsel takes notice for the 6th respondent; and Mr.A.K.Manikkam, learned Special Government Pleader takes notice for the newly impleaded 7th respondent.

5.Post the matter on 04.03.2022.
