Justice P.N.Bhagawathi, speaking for the Constitution Bench, sown the seeds for establishment of “National Court of Appeal”, which would try all the issues arises from various High Courts, where the lis is between the individuals and the Supreme Court would be confined to interpretation of Constitution, Question of National importance, suits between the Union and states, states & states, presidential reference under Articles 143, 317 of Constitution, election disputes pertaining to president & vice-president and statutory appeals under various statues such as under representation of peoples Act, Salt Act, Customs Act.
when our constitutional adviser Sri. B.N.Rau, sought the opinion of Justice Felix Frankfurter of U.S.Supreme Court with regard to functioning of Supreme Court it was advised that Supreme Court being the court of last resort should sit “enbanc” i.e. enmass, and should decide only questions of national importance and interpretation of constitution.
