Today 08.07.2020, HCP filed by mother of Nalini (Life convicts prisoners in Ex Prime Minister Rajiv Gandhi assasination case) was listed as item no.18 before the hon’ble bench consisting of His lordship Mr Justice Kirubakaran and Her Lordship Mrs.Velumani. Prayer sought in the HCP was that seeking permission of the court for Sri Murugan and Nalini to make video from the prison to UK where the mother of murugan is residing and to Sri Lankan where sister of Murugan is residing. Last hearing the hon’ble court directed the State PP to get instruction from the state government whether these prisoners can be allowed to talk to their mother and sister of murugan who are living in abraod (UK and Srilanka) only on humanitarian ground. State Public Prosecutor Mr.A.Natarajan appeared and informed that as per the instruction given by the prison authority the State government had promtly written a letter to the Ministry of Home Affairs, Government of India asking for their permission in this matter and Till today reply is awaited. State PP informed the court that the state goverment is ready to comply with the order whaterver this hon’ble court directs but the state government cannot take any decision on its own since matters are relating to external affairs ministry and security of the country is the prime important.State PP also vehemently objected to the contention of the Petitioners counsel that foreigners are allowed to have interview through whatsapp even to foreign countries. For which state PP informed that either foreign prisoners or indian prisoners are not allowed to make overseas whatsapp call or any normal calls to foreign countries and their interview rights are also restricted only within india as per the G.O.Ms.524 of 2011 and as per Tamilnadu Prison Manual. State PP also asked the petitioners counsel why he is shy in impleadin the Ministry of External Affair and Ministry of Home Affair as a party to the case and what way they will be affected in adding them as parties. After elobarate arguments the Hon’ble court suo moto impleaded the Ministry of External Affairs and Ministry of Home Affairs Government of India and also directed the state PP to file the copy of the letter issued by the state government to Ministry of Home Affairs Government of India on next hearing and for the reason the case is adjourned to 15.7.2020.
