[9/23, 17:45] Sekarreporter 1: The entire world is in a panic pandemic situation and wanting funds for curing and treatment towards the coronavirus deadly disease and the petitioner Mr. Senthil balaji being a responsible citizen and member of legislative assembly of aravakurichi constituency has requested to take his mla allotted funds for the treatment of general public suffering from pandemic disease. Karur being the district headquarters of the district and the general hospital available at krishnarajapuram requested the District collector to grant permission to the hospital and allow them to use the funds of MLA since the people are mixed from all the constituency in the one district.
The collector initially granted orders for utilisation of funds from mla funds but mysteriously within 3 days cancelled the order for extraneous consideration submitted by Senior Advocate Mr. S. Prabakaran. It was further submitted the learned senior counsel that the entire world is suffering with the unidentifiable disease and the mystery around it and the government should be generous in using the funds since the issue is more public interest involved and when the government by itself has withdrawn 1 core from each MLA, why not the Mla from his own constituency could be barred from using such funds. Hearing the submissions of senior counsel Mr. S. Prabakaran and on behalf of the state. The Honble division bench consisting of Honble Mr. Justice M.M. Sundaresan and R. Hemlalatha.jj set-aside the impugned order of the collector and directed the collector to utilize the funds of MLA Senthil Balaji by allowing the writ petition as prayed for.
