AFFIDAVIT OF E.MUNUSAMY

 

I, E.Munusamy, son of Elumalai, aged about 41 years, residing at No. 608, N.C.S Nagar, Poondi Post and Village, Thiruvallur District 602023 now temporarily come down to Chennai solemnly and sincerely state and affirm as follows-

 

  1. I am the petitioner in the aforesaid writ petition and I am well acquainted with the facts and circumstances of the case.

 

  1. I am filing this writ petition to direct the respondents no. 1 to 3 and 7 to intervene and defer the election to the 6th respondent proposed to be conducted pursuant to the notification dated 06.08.2021 atleast by 3 months or till the pandemic is eradicated and normalcy is restored or till the time this Hon’ble Court deems just and proper in the circumstances of the case.

 

  1. I joined the Metropolitan Transport Corporation in the year 2008 and I am working in Ayyappanthangal Depot. The State Transport Corporation is operating throughout the state of Tamil Nadu. The employees working throughout Tamil Nadu in the State Transport Corporation are members of different unions. One of the major union in the Transport Corporation is Anna Thozhilchanga Peravai viz. 6th respondent and I am a member of the said Peravai, which is a trade union.

 

 

  1. The office bearers for the 6th respondent Peravai are elected by secret ballot. The office bearers are elected for the depot, for the zone and ultimately for the state level organization. The 6th respondent Peravai has members throughout Tamil Nadu. The depot wise office bearers have to be elected, the zone wise office bearers have to be elected and ultimately the office bearers on the state level have to be elected. There are about 1,40,000 members in the 6th respondent Peravai working in various parts of Tamil Nadu, who will have to participate in the election process to elect the office bearers. Due to pandemic times the election was not conducted and the existing office bearers are continuing.

 

  1. The Ayyappanthangal Depot where I am working comes within the Metropolitan Transport Corporation Ltd.(South). Apart from my depot, there are 15 other depots and the Head Office (Pallavan House) also falls within the South Zone. There are about 8,223 members in the South Zone itself.

 

  1. Due to Covid19 pandemic, there had been total lockdown throughout the country from 25.03.2020 under The Disaster Management Act, 2005. The lockdown is continued by giving certain relaxations. Under the restrictions imposed, there cannot be congregation or any meeting and in general there cannot be any large gathering.

 

  1. While so, the 4th and 5th respondent had issued an election notification on 6.8.2021. As per the said notification the election schedule for electing the office bearers throughout Tamil Nadu from among the members to the various office bearer posts will commence from 8.8.2021. The election is sought to be conducted in 5 stages.

 

 

 

 

  1. The 1st stage of election is for Nagarcoil, Thirunalveli, Thoothukudi, Virudunagar, Madurai, Kumbakonam, Nagapattinam, Trichy, Karaikudi and Pudukottai. The election schedule is as follows-

  1. The election is sought to be conducted for each zone in one place. For example, in respect of Metropolitan Transport Corporation (South), the members have to cast their vote in the election booth set up at Velacherry, Amma Mandapam. In respect of Metropolitan Transport Corporation (North) the same is in T.K.A.Mahal, Villivakkam. Like this throughout Tamil Nadu for each zone a place is identified and named to cast vote in the election. The places so identified cannot accommodate large gathering of workmen who come to cast their vote from various parts of their zone. The other norms such as social distancing, wearing mask, sanitizing, hand wash etc. cannot be monitored and there is no instructions in this regard in the election notification.

 

  1. In the Metropolitan Transport Corporation (South Zone) alone there are 8223 members who are working in 16 depots and also in headquarters. All the members will have to go to Velacherry Amma Mandapam to cast their vote, which is a small place and it cannot accommodate the 8000 and odd members of the 6th respondent Peravai. The election schedule will indicate that there is hardly any time for campaigning and the members will have to travel a long distance on a working day to cast their vote and the time given for exercising the franchise is only 5 hours. In respect of places outside Chennai, the distance to be travelled by the members to cast their vote will be even much higher. The short duration in which the election sought to be conducted will only result in many members getting gathered in the polling booth and creating danger to one another in the pandemic time. Such gathering is also prohibited by the Government and it will be in violation of the standard operating procedure. There is absolutely no requirement to hold the election when there is threat of 3rd wave looming in.

 

  1. If the elections are conducted as per the schedule, it will cause serious danger to one and all, particularly the public. Most of the members who will be casting their vote are all employees who are in contact with the public on day to day basis either as a driver, conductor/technician. As stated above, the congregation of all the members in the election station to cast their vote is prohibited by the notifications issued by the Government. It is not advisable for the employees to get gathered in a place where social distancing is hard to maintain in view of the limited place available in the polling station. Even for marriages, death etc. there is restriction of number of people getting gathered. When that be so, it is totally not advisable to conduct the election for the zone at one single polling booth, wherein thousands of employees will gather to cast their vote. The election should be conducted atleast depot wise, so that only people within the depot and who are members of the 6th respondent Peravai will cast their vote. The stages in which the election is sought to be conducted will have a chain of events which will spread through the entire state.

 

  1. I am paying the union subscription to the 6th respondent Peravai by check off system. My name is found in serial number 277, in the Ayyappanthangal Depot and at serial number 6572 in the South Zone list. I have addressed a representation to the respondents and I have requested to defer the election by 3 months in the interest of the members of the union as well as the general public. The government is fighting with the pandemic for more than 1 year and 5 months and the pandemic is yet to vanish. If the election is conducted at this juncture, which involves large gathering of workmen to cast their vote in a short duration of time, viz. 5 hours it will cause grave havoc to one and all and irreversible damage will be caused.

 

  1. In such circumstances, I requested the respondents no. 1 to 3 to intervene in the matter and defer the election to the 6th respondent Peravai atleast by 3 months or till the pandemic is eradicated and normalcy is restored. However, the 4th and 5th respondent are not in a mood to defer the election. On the face of it the notice dated 06.08.2021 is contrary to law and the provisions of the Disaster management Act 2005, and therefore, is liable to be declared so for the following among other

 

G R O U N D S

 

  1. The notice dated 06.08.2021 of the 4th and 5th respondent regarding election to elect the office bearers of the 6th respondent is illegal and contrary to law.

 

  1. There are about 1,40,000 members in the 6th respondent who are working in the State Transport Corporation in various places throughout Tamil Nadu and they will have to cast their vote to elect the office bearers of the 6th In the midst of the pandemic and when the experts are predicting the 3rd wave from middle of August 2021 or from the beginning of September 2021, issuing a notice to conduct election to elect the office bearers in 5 stages commencing from 14.08.2021 to 17.09.2021 is grossly illegal and contrary to the notification issued by the Government of Tamil Nadu under the Disaster management Act 2005, restricting/prohibiting the gathering.

 

  1. There are several zones in which election has to be conducted throughout Tamil Nadu. In each of the zones there are thousands of employees who will have to move from different location and converge at the location identified for polling the vote. This involves extensive travelling of large body of workmen and converge as a gathering in the place of election. Such a gathering in the prevailing circumstances is prohibited and the same is not good for the employees and the same will result in causing harm to the general public. While so issuing the notification at this juncture when the existing office bearers are continuing, does not achieve any purpose.

 

  1. The election is conducted in 5 stages commencing from 14.08.2021 to 17.09.2021. Such an election process involving thousands of employees will have a cascading effect, as the employees who are all working as drivers, conductors and technicians, are in direct contact with the general public. Therefore, permitting the employees’ congregation in the name of election will endanger one and all.

 

  1. The notification for election dated 6.8.2021 does not contemplate adherence to social distancing, sanitizing, wearing the mask. Further, there is no instructions regarding following the directions issued under the Disaster Management Act. While so, conducting election is illegal.

 

  1. The time fixed for casting vote is only 5 hours in which thousands of employees have to cast their vote and the same will result in gathering of several thousand employees at the same time making it impossible to maintain the standard operating procedures. As per the Government Norms, even in respect of marriage related gathering only 100 guests and in respect of funeral/ last rights only 50 persons are permitted. No gathering for no other purpose is permitted. While so, conducting election involving 1,40,000 employees is totally unjustified.

 

  1. The election to elect the office bearers of the union is not a ritual. If the election is held in the pandemic, there is a threat to life not only to the members of the union but also to the general public, as there is every likelihood of spread of the pandemic. In the neighbouring states, there is steep increase in the number of covid cases. If the election is to be held as per the schedule, it will not only be in violation of The Disaster Management Act but also in violation of Article 21 as the life of public will be also be put in danger and also in violation of Article 19 (1) (a) of the Constitution of India.

 

  1. The 7th respondent has issued G.O.M.S.No. 364 dated 03.05.2021 and by that all the social/ political/ sports/ entertainment/ academic/ cultural/festival related and other gatherings in both open and closed space has been prohibited. While so, the election notice is contrary and in violation of the aforesaid government order.

 

  1. The other reasons assigned for conducting election amidst pandemic is totally unjustified

 

  1. It is submitted that, the election notification was issued only on 6.8.2021 in the “Namathu Amma” Tamil Daily. Immediately, I have made representation to the respondents on 09.08.2021 and there is no positive response. I am having a valid vote and I will not be able to cast my vote risking my life. This will be the case for other employees as well. Therefore, no purpose will be achieved by conducting the election now. Therefore, it is prayed that this Hon’ble Court maybe pleased to grant injunction restraining the respondents from proceeding to conduct the election to elect the office bearers of the 6th respondent pursuant to the notice published in the “Namathu Amma” Tamil Daily in the 6th August 2021 edition pending disposal of this writ petition.

 

  1. It is submitted that the respondents no. 1 to 3 are bound to protect the interest of the public by preventing the 4th and 5th respondent from conducting the election in these pandemic times. The very notice issued by the 4th and 5th respondent is per se illegal, as it does not contemplate adherence of any standard operating procedures. Therefore the writ petition as filed by me is maintainable in law.

 

  1. It is submitted that I have no other effective alternative remedy except to approach this Hon’ble Court under Article 226 of the Constitution of India. It is further submitted that I have not filed any other writ petition for the relief sought for in this writ petition.

 

  1. For the reasons aforesaid it is prayed that this Hon’ble Court maybe pleased to issue appropriate writs, orders, directions and more particularly a writ in the nature of MANDAMUS, direct the respondents no. 1 to 3 and 7 to intervene and defer the election to the 6th respondent proposed to be conducted pursuant to the notification dated 06.08.2021 atleast by 3 months or till the pandemic is eradicated and normalcy is restored or till the time this Hon’ble Court deems just and proper in the circumstances of the case and pass such other orders or directions as this Hon’ble Court may deem fit in the circumstances of the case, award cost and render justice.
