In most of the time the CRPC is infringing the fundamental rights and other legal rights, it due to lack of constitutional courts and it’s enforcement. practically I have dealt one writ petition, in which a SC person bought a house property in main village and for the about one decade his family was prevented to construct a house and to reside their.our MHC without restoring the infringed fundamental rights the writ petition was disposed by giving liberty to file civil suit. it shows lack of knowledge and understanding of constitutional fundamental rights and it’s enforcement valve.In that specific case a citizen deprived of his almost 10 fundamental rights, MHC failed in his constitutional duty knowingly……..ok…..
………. the modern democracy is something different from traditional democracy ( India still in traditional democracy ). The framers of constitution aimed to make India in different aspects, which survived only upto mid of 1970s, after which it going in downtrend till now, which is dangerous and alarming circumstances to constitution and of our nation building process…….thanks and follows…..
