Since the issue involved in this case assumes significance, to improve the standard of investigation and to improve the quality of criminal justice system, we deem it fit to hear this case from time to time and issue appropriate directions based on the status report filed before us. As a sequel to the earlier order passed by this Court on 10.10.2022, the matter was posted for hearing today.  Considering the seriousness of the issue involved in this case, the State was represented by Mr.R.Shunmugasundaram, learned Advocate General, assisted by Mr.A.Thiruvadikumar, learned Additional Public Prosecutor and the Director General of Police was represented by Mr. Hasan Mohamed Jinnah, learned State Public Prosecutor.

 

2.A status report has been filed by the Director General of Police along with the proceedings in Rc.No.70699/A&R-1/2022 dated 04.11.2022.  For proper appreciation, the relevant portions in the status report are extracted hereunder:

“4.After elaborate discussion, it was decided that to begin with, the separation of law and order and investigation wings shall be done in 11 Taluk Police Stations with one Police Station in each of the Range Headquarters.  The rationale for choosing these Police Stations is that.-

  1. They have adequate man power
  2. The number of cases reported in these Police Stations are also substantial

III. The performance of these investigation units can be monitored closely by Senior Police Officers.

 

Further one Police Commissionerate i.e., Coimbatore city has also been chosen for the above scheme.  In Coimbatore City Police Commissionerate, the Crime Police Stations will function as investigation wings.

 

 

5.The Investigation wings have been assigned to investigate serious offences so that there will be more focus and better results.

 

6.After evaluating the performance of the above scheme, it would be expanded further to other Police Stations of the Districts and Commissionerates in due course.”

 

  1. The learned Advocate General brought to our notice the proceedings of the Director General of Police dated 04.11.2022 and submitted that 11 Taluk Police Stations with one Police Station each of the Range Headquarters has been identified by taking into account the number of serious crimes that are handled by these police stations and a Special Investigation Wing will be formed. The learned Advocate General further submitted that apart from the 11 Taluk Police Stations, the entire Coimbatore City has also been brought into the scheme and the Crime Police Stations falling within the Coimbatore City Police Commissionarate will be functioning as the Investigation Wings.

 

  1. The learned State Public Prosecutor appearing for the Director General of Police submitted that the Investigation Wing will focus on the investigation in the following types of cases:

i.Murder/murder for gain

ii.Dacoity

iii.Robbery

iv.Suspicious death

v.Grace burglary

vi.Fire Arms/Explosive cases,

vii.Kidnapping for ransom

viii.Cases involving caste & religious clashes,

ix.Fatal accidents involving multiple deaths.

x.Any other important cases assigned by the Superintendent of Police/Commissioner of Police to the Investigation Wing.

The learned Advocate General submitted that the suggestions that were put forth by this Court will be implemented in a phased manner throughout the State of Tamil Nadu and the choice of 11 Taluk Police Stations along with Coimbatore City is only a beginning and this will be taken as a test case before the same is implemented across Tamil Nadu.

 

  1. We appreciate the immediate follow up action taken by the State and the Director General of Police in this regard. As the next step, the police personnel, who are exclusively involved in investigation wing, shall be provided with sufficient training in investigation techniques, particularly, considering the improvement in information technology crimes and the electronic evidence that is being used in the course of investigation.  The learned Advocate General submitted that sufficient training will be given and there is already a module available in the Police Academy.
