A practicing advocate Ms. Abinaya Muthu, ordered online a Half Non Veg
meals for a cost of Rs.185/- on 22-02-2024 from Anjappar Restaurant,
Nungambakkam Branch using Swiggy platform. After receiving the food she
appallingly discovered a dead cockroach in the Half Non Veg meals causing her
abounding physical and mental agony. She had awakened and attempted to
inform the Restaurant about the circumstance despite the restaurant failed to
consider it. Immediately she contacted the Tamil Nadu Food Safety Department
monitoring food safety upon vendors about the deficiency in service rendered
by the Restaurant. Thereafter a consumer complaint with the aid of Mr.
Sanathkumar advocate filed before the District Consumer Dispute Redressal
Commission (North) Chennai in C.C. No. 91 of 2024 and the same got disposed
in her favor on 20-08-2025. The District Commission summoned the Food
Safety Officer to know the steps taken upon the online Complaint lodged before
them by the Complainant Ms. Abinaya. The Report filed by the Food Safety
Officer exposed the fact that valid license was not displayed in the prominent
place of the Restaurant, food handlers were not wearing cap and gloves, pest
control annual maintenance record not assessed properly, prepared food was
stored in refrigerator not being labeled, food packing area was not maintained
properly, food & water analysis report was not produced, FOSTAC trained
person not available in the Restaurant and also identified smoke residue at
their kitchen. The District Commission noted down the enquiry report of the
Food Safety Officer in the Complaint lodged by Ms. Abinaya Muthu and noticed
that the Anjappar Restaurant failed to challenge the enquiry Report provided
by the Food Safety Officer. The District Commission recognized the proximity of
the follow up actions taken by the Complainant Ms. Abinaya Muthu and
passed an order against the Anjappar Restaurant, Nungambakkam Branch
directing to provide a compensation of Rs.10,000/- towards deficiency in
service, mental agony, pain and sufferings along with Rs.2,000/- towards
litigation expenses.
