Affidavit of the Petitioner
I, P Naveenprasad, S/o Pandiyan, No 3/41-, Adi Darvidar Colony, Anaikattu, Vellore District, 632101, aged about 39 years, temporarily come down to Chennai, solemnly affirm and sincerely state as follows:-
1. I respectfully submit that I am the Petitioner herein and am well acquainted with the facts and circumstances of the present case. I further state that this public interest litigation is not filed with any personal interest but in the welfare of the public at mind and not made on vexatious and frivolous grounds. I further submit that I am filing this public interest litigation with my own funds and I undertake that I will pay the cost if any, if the present petition is found to be intended for personal gain or oblique motive. I am an Income Tax Assessee with PAN No. _____________, Aadhar No. ________________, having Annual Income from Profession: Gross Receipts of Rs.6,00,000/-.
2. I respectfully submit that I am a practicing Advocate before the Courts at the vellore district and before this Hon’ble High Court and I am filing the present writ petition in public interest to protect the dignity, authority, and institutional integrity of the judiciary.
3. I respectfully submit that I came to know through news reports and publicly available material that a book titled “Thirupparankundran Affair: Is GRS a Judge or has been published by a publisher known as “Keezhaikaatru”, 5th respondent herein.
4. I respectfully submit that the said book is admittedly directed against Hon’ble Mr. Justice G.R. Swaminathan, a sitting Judge of this Hon’ble Court, and the very title of the book is scandalous, abusive, and derogatory.
5. I respectfully submit that the cover page of the said book, as seen from the reports, portrays the Hon’ble Judge in a mocking and distasteful manner with a clear intent to insult and undermine the authority of the judiciary.
6. I respectfully submit that the language used in the title and presentation of the book is per se contemptuous and is calculated to lower the dignity of this Hon’ble Court in the estimation of the general public.
7. I respectfully submit that I further came to know through news reports that the said publisher, 5th respondent herein, has been allotted Stall Nos. 172 and 173 at the Chennai Book Fair commencing on 08.01.2026.
8. I respectfully submit that if the said book is permitted to be displayed, sold, or circulated at a public forum such as the Chennai Book Fair, it would cause serious and irreversible damage to the credibility and institutional authority of the judiciary.
9. I respectfully submit that I have sent representations to Respondents 1 to 4 on 06/01/2026.
10. I respectfully submit that in view of the book fair starting on the 8th of this month, I am constrained to move this court shortly after giving representations only because I got know about this at the last minute.
11. I respectfully submit that in the absence of any action from the respondents, I am constrained to approach this Hon’ble Court seeking appropriate directions.
GROUNDS
A. Permitting the public sale and circulation of the said book would irreparably erode public faith in the judiciary and disturb the administration of justice. Independence of the judiciary is the soul of the constitution.
B. The inaction of the respondent authorities in preventing the circulation of such contemptuous material is violative of their constitutional statutory obligations.
C. Permitting the public sale and circulation of the said book would irreparably erode public faith in the judiciary and disturb the administration of justice.
It is therefore most respectfully prayed that this Hon’ble Court may be pleased to issue a Writ of Mandamus, directing the respondents to seize the books and to prohibit their circulation, and pass such further or other orders as this Hon’ble Court may deem fit and proper in the circumstances of the case.
