SYNOPSIS
The petitioner, a Secondary Grade Teacher was placed as S.No.1 in the seniority list for promotion to the post of BT Assistant Science issued by the 3rd respondent on 17.03.2020. During the year 2020 there were 2 vacancies in the 3rd respondent block, which was mentioned in the seniority list itself. The normal promotion counseling for the year 2020 has not been conducted in May/June 2020 due to Covid lock down. Had the promotion counseling was conducted, the petitioner would have got promotion as BT Assistant – Science.
Without conducting the counseling for those vacancies that arose in the year 2020, the 1st respondent issued Impugned Proceeding Na.ka.No.756/D1/2021 dt. 05.02.2021 directing the 3rd respondent to prepare seniority list as on 01.01.2021. On 19.02.2021, the 1st respondent rescheduled the Promotion counseling. As per the schedule promotion to the post of BT Assistant counseling is scheduled to be held on 27.02.2021.
The 3rd respondent issued a revised seniority list on 19.02.2021, placing the petitioner below the 4th and 5th respondents herein. Hence challenging the proceedings Na.ka.No.756/D1/2021 dt. 05.02.2021 issued by the 1st respondent, directing the 3rd respondent to prepare seniority list as on 01.01.2021 and the consequential seniority list issued by the 3rd respondent dt.19.02.2021, this writ petition is filed.
