ORDER
O.A.No.905 of 2025 has been filed to grant an order of ad interim injunction restraining the Respondents/Defendants 1 to 29 or any other person or such other websites which are discovered by the plaintiff after the release of
the movie from infringing the cinematographic film AABEER GULAAL and said work be directed to block all websites/web pages and future websites (including their prefix and suffix) and those Non Compliant websites mentioned in Schedule A hosting contents that relate to Plaintiffs copyright protected cinematographic film AABEER GULAAL in any manner, thereby restraining the unauthorised copying, transmission, communication or make available or display or release or show or upload or download or exhibit or play and/or in any manner communicate in and/or through their services immediate of receipt of details of such infringing websites/web pages in writing, pending disposal of
the above suit.
2.O.A.No.906 of 2025 has been filed to grant an order of ad-interim injunction restraining the Respondents 1-5/Defendants 30-34 or any other person or entity from infringing the cinematographic film “Aabeer Gulaal” by themselves, their partners/proprietor/directors, heirs, representatives, successors in business, assigns, distributors, agents, servants or anyone claiming through
them or under them from infringing the cinematographic film AABEER GULAAL by copying, recording, reproducing or allowing Camcording or
allowing others to transmit, communicate or make available or distributing or duplicating or displaying or releasing or showing or uploading or downloading or exhibiting or playing and/or in any manner or downloading or exhibiting or
playing and /or in any manner whatsoever from communicating the cinematographic film AABEER GULAAL and said work manner without a proper license from the Plaintiff or in any other manner which would violate/infringe the plaintiffs copyrighted cinematographic film AABEER GULAAL through different mediums including but not limited to CD, DVD, Blu-ray disc., VCD, cable TV, Direct to home services, internet services multimedia messaging services, pen drives, internet services, multimedia messaging services, pen drives, hard drives, tapes, DAS, satellite Conditional Access Systems or in any other medium/manner whatsoever, pending disposal
of the above suit.
3.As proof of the Applicant/plaintiff’s ownership of the copyright, the plaintiff has filed the CBFC certificate describing the plaintiff as the producer of the movie. The promotional material indicates that the movie is slated for
release today.
4.In matters of this nature, it is likely that irreversible injury will occur unless unlawful broadcast is restrained. At the same time, it is possible that the legitimate business interest of one or more respondents may be affected on account of the expansive nature of relief claimed. Therefore, it is just and
necessary that the plaintiff indemnify in respect thereof.
5.Subject to the aforesaid condition, orders of ad interim injunction as prayed for are granted in these applications until 10.10.2025. Issue notice to the respondents returnable on 10.10.2025. Private notice is also permitted. The
applicant shall comply with Order XXXIX Rule 3 CPC.
