Madras high court quashes corruption case against security officer of late Tamil Nadu CM Karunanidhi


Fourteen years after registration of a corruption case against a personal security officer (PSO) of former Tamil Nadu chief minister M Karunanidhi in connection with allotment of 10 cents of land under the govt’s discretionary quota (GDQ) in the impeccable honest govt servant category, Madras high court has quashed the final report filed in the case.

“The entire proceedings are nothing but clear abuse of process of law and cannot be sustained, and the proceedings are liable to be set aside,” Justice G K Ilanthiraiyan said.
Further, on perusal of the entire records, none of the prosecution witnesses had spoken about any knowledge or involvement of any of the officials in the department for commission of conspiracy, misconduct, suspicious circumstances, if any, prevailed under which office note had been prepared, signed and approved by the officers concerned, stage by stage while allotting the house plot in favour of the PSO C Ganesan, the court said.

According to the prosecution, Ganesan submitted an application requesting the Tamil Nadu Housing Board (TNHB) for a house plot under public quota. On receipt of the same, the housing and urban development department initiated an office note to allot a vacant High-Income Group (HIG) plot measuring 4,370 square feet of the Mogappair Eri Scheme, TNHB, under GDQ in the impeccable honest govt servant category.
The office note was approved by the then joint secretary to govt and thereafter by the then secretary of housing department and thereafter by the then housing minister I Periyasamy.

  
An order was issued on March 10, 2008, and the plot was provisionally allotted to Ganesan.
The prosecution alleged that even before the receipt of the provisional allotment order and without obtaining permission from TNHB, Ganesan entered into an agreement for joint development of the plot with one K Padma for ₹74.13 lakh. Subsequently, the plot had been sold for ₹1.01 crore, it said.”
