PRAYER : Writ Petition filed under Article 226 of the Constitution of India directing the Respondent to forthwith instruct all subordinate police officials though out the state of Tamilnadu to consider and grant necessary permissions to the petitioner party for conducting political campaigns led by its party leader, Mr. Vijay Across the state of Tamilnadu between 20.09.2025 to 20.12.2025 on the basis of the petitioners political party representation dated 09.09.2025 by the consideration of the Representation of the petitioner dated 15.09.2025 in a fair, uniform and non – discriminatory manner, within a time frame fixed by this Hon’ble Court and in accordance with law.

ORDER
This petition has been filed for a direction to the subordinate police officials throughout the State of Tamil Nadu to consider and grant necessary permissions to the petitioner party for conducting political campaigns led by its party leader, Mr. Vijay across the State of Tamil Nadu between 20.09.2025 to 20.12.2025 by the considering the representation of the petitioner dated
15.09.2025 in a fair, uniform and non – discriminatory manner.
2.Considering the nature of the relief sought and taking note of the various incidents of damage of the public property which had occurred earlier in huge gatherings of political parties and having regard to the fact that the sufferers or victims are not compensated for the loss suffered by them, this Court is of the view that there must be proper guidelines to be set out by the Government in this regard.
3.Whenever there are huge public gatherings, the properties of the innocents are the easy target. Though the Tamil Nadu Property (Prevention of Damage & Loss) Act, 1992 (Tamil Nad Act 59 of 1992) was enacted to prevent widespread damage to the public property, an amendment is also brought by way of Act 46 of 1994 to prevent widespread damage to the private property also. The very object of the Act and its amendment is to make the political parties or communal or ethnic or any other group organising demonstration or gathering and mobilise huge group, resulting in damages to public property, liable and to compensate the loss suffered by the victims. Only to remedy such situation, the Act has been enacted. Though suitable punishment is provided under the Act and the Rules provides for compensation, the same has not been properly implemented for all these years. Therefore, in order to indemnify any such loss that may arise during such huge gatherings, this Court is of the view that there must be strict conditions to be imposed by way of deposit of an amount to indemnify the losses.
4.Therefore, in such view of the matter, let the State Government come up with the guidelines with regard to the collection of Security Deposit from the political parties who intend to have such huge public meetings, gatherings or demonstrations, etc.
5.For filing such report, post the matter on 24.09.2025.
