ORDER
The instant writ petition has been filed challenging the refusal to register the petitioner’s name in the Tamil Nadu Medical Council.
2.The learned counsel appearing for the petitioner would submit that the petitioner has completed M.D.(Paediatrics) in Raja Rajeswari Medical College and Hospital,
Bangalore, and that there is an affiliation issue between Dr.M.G.R. Educational and
Research Institute, Chennai, and Rajiv Gandhi University of Health Sciences, Bengaluru. The learned counsel would further submit that taking advantage of the affiliation issue between the two Universities, the fourth respondent is refusing to register the petitioner’s name in the roll of Tamil Nadu Medical Council. He would submit that whereas, the petitioner’s name has already been registered before the Karnataka Medical Council, and that Karnataka Medical Council has also given no objection certificate to register at Tamil Nadu. The learned counsel would submit that, the petitioner being resident of Tamil Nadu and wants to practice here, he wants to register in the roll of Tamil Nadu Medical Council. He would further invite the attention of this Court that the National Medical Council has also certified that the Degree obtained by the petitioner is a recognized one and can be registered before the
Medical Council. In this regard, the learned counsel relied upon the certificate given by
Dr.M.G.R. Educational and Research Institute, Chennai and also the letter given by National Medical Council dated 08.07.2025 and the no objection letter of the Karnataka Medical Council dated 17.04.2025.
3.Though the fourth respondent raised concern about the affiliation of the University, they have no serious objection about the petitioner’s study at Raja Rajeswari Medical College and Hospital, Bangalore, in M.D.(Paediatrics). Therefore, this Court finds prima facie case in favour of the petitioner. If the registration is delayed it would directly affect the right to life of the petitioner. Hence, this Court directs the fourth respondent to register the name of the petitioner in the roll of Tamil Nadu Medical Council for the Degree in M.D.(Paediatrics), subject to compliance of other applicable Rules as per the Tamil Nadu Medical Registration Act, within a period of one week from the date of receipt of a copy of this order.
4.The above order is subject to the outcome of the writ petition.
5.Post the writ petition on 14.08.2025.
