O R D E R
By consent of both the learned counsel for the parties, the Writ
Petition is taken up for final disposal, at the admission stage itself.
2. The instant writ petition has been filed with a prayer for issuing aMandamus, directing the Respondents Nos.1 to 6 to take departmental and legal action against the Respondents Nos.7 and 8 on the Petitioner’s representation dated 28.02.2025 within the time to be stipulated by this Court.
3. Heard the learned counsel for both sides and perused the materials available on record.
4. It is the pathetic case of the Depot-Manager serving in TASMAC. It is the contention of the petitioner that when he made a surprise inspection at Shop No.6489 situated at Keelakavattankurichi, Ariyalur District on 05.01.2025, the Staff working in that shop has man-handled and attacked the petitioner. It is the further contention of the petitioner that as per the Standard Operating Procedure, he has given complaint to the 6th respondent and other respondents namely respondents 1 to 5. It is also the further contention of the petitioner that the then District Manager, who is arrived as 8th respondent, has intimidated the petitioner to withdraw the complaint.
However, the fact remains that the complaint of the petitioner in respect of an attack, which has happened on 05.01.2025, is pending before the respondents.
5. At this juncture, the learned Standing Counsel appearing for the respondents 3, 5, 6 and 7 would submit that they will consider the petitioner’s representation within a reasonable time.
6. I have given my anxious consideration to the submissions made on either side.
7. It is the very pathetic case where an employee of the RespondentsCorporation having given complaint that some of the Subordinates have assaulted him, the non-action since January-2025 would only show the non-functioning of the Management. It is appropriate that as and when such serious complaint comes before the Authority, they must take immediate action, wherein in this case, for the reason best known to them, no action had been taken.
8. Therefore, considering the seriousness of the petition, this Courtdeems it appropriate to direct the 3rd respondent to take immediate action upon the petitioner’s representation dated 28.02.2025 and after affording opportunity to the respondents 7 and 8, pass orders on it’s own merits and in accordance with law, within a period of two weeks from the date of receipt of copy of this order.
9. With the above direction, the Writ Petition is disposed of. No costs.
