AFFIDAVIT OF THE PETITIONER
I, Prabhakaran, C/o. K. Balamurugan, Hindu aged 62 years, residing at No.35, Kamala Nehru Nagar 1st Street, Choolaimedu, Chennai – 600094, do hereby solemnly affirm and sincerely state as follows: –

1. I am the petitioner herein and I am well acquainted with the facts of the case.

2. I submit that the present Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the 1st respondent to consider and act upon the petitioner’s complaint dated 08.04.2026 about large-scale financial irregularities and corruption in the bridge reconstruction project undertaken by the 3rd respondent Corporation.

3. I submit that I am filling this Writ Petition out of my own funds and I am not filling this for my personal gain or for the interest of any third party or individual. My Aadhar Card No. 4609 8880 5198. I am a public-spirited person. I am filing this writ petition as public interest litigation. I give an undertaking to pay the cost of this Hon’ble Court finds that this petition is intended for personal gain or oblique motive. Further, I submit that I have filed this petition out of my own fund.

4. I submit that the 3rd respondent Corporation proposed demolition and reconstruction of a bridge across Otteri Nullah connecting Aspiran Garden II Street and Kilpauk Garden Road, Division No.98, Zone VIII under Project Code No.04/J/1806/2022-23 and Estimate No.J/2022-23/7237.

5. I submit that respondents 4 to 8 being public officials of the Greater Chennai Corporation were directly involved in the planning, execution, supervision and certification of the said project and the 9th respondent is the contractor entrusted with execution of the work.

6. I submit that upon obtaining official records through applications filed under the Right to Information Act and upon field verification, serious discrepancies came to light indicating inflation of estimates, improper utilization of public funds and possible collusion between officials and the contractor.

7. I submit that under the head “Land Acquisition”, a sum of Rs.20,00,000/- had been allocated. However, RTI replies revealed that no acquisition proceedings were undertaken and only encroachments were removed. The RTI reply further disclosed that six houses alone were identified for demolition and resettlement amount was merely deposited with TNUHDB, awaiting allotment orders. Hence, the allocation under the said head raises serious suspicion regarding the misappropriation of public funds.

8. I submit that under the head “Lighting Arrangements”, though an amount of Rs.20,00,000/- had been allocated, RTI records disclose expenditure only to the extent of Rs.2,358/- and Rs.9,112/- respectively, thereby revealing huge unexplained discrepancy between sanctioned and actual expenditure.

9. I submit that under the head “Shifting of Services”, a sum of Rs.20,25,000/- had been allocated without furnishing any supporting records, work details, measurements or audit particulars despite specific RTI queries.

10. I submit that a further amount of Rs.31,96,106.58 had been booked under the vague category of “Unforeseen Items” without any supporting break-up particulars or technical justification, thereby warranting detailed forensic scrutiny.

11. I submit that the aforesaid materials prima facie disclose cognizable acts of corruption, abuse of official position, criminal misconduct, falsification of records and diversion of public funds, attracting provisions of the Prevention of Corruption Act, 1988 and other penal enactments.

12. I submit that therefore I submitted a detailed complaint dated 08.04.2026 before the 1st respondent seeking initiation of an enquiry and appropriate criminal and departmental action against the persons involved.

13. I submit that despite receipt of the complaint, no effective action has been taken by the 1st respondent till date and the complaint remains unattended. I further submit that the 4th respondent had already retired from service in the year 2024 and the 5th respondent is due to retire from service on 30.05.2026. In such circumstances, unless immediate enquiry and consequential action are initiated, there is every likelihood of the officials concerned evading accountability and frustrating further proceedings relating to the serious financial irregularities and acts of corruption disclosed in the petitioner’s complaint.

14. I submit that I have no other efficacious alternative remedy except to invoke the extraordinary jurisdiction of this Hon’ble Court under Article 226 of the Constitution of India.

It is therefore prayed that this Hon’ble Court may be pleased to issue a
Writ of Mandamus directing the 1st respondent to consider the petitioner’s complaint dated 08.04.2026 and consequently conduct investigation against respondents 4 to 9 in connection with the bridge reconstruction project across Otteri Nullah connecting Aspiran Garden II Street and Kilpauk Garden Road, Division No.98, Zone VIII, Greater Chennai Corporation Project Code No.04/J/1806/2022-23 and take appropriate action in accordance with law within a time frame and if the offence made out file the charges against them with in time frame fixed by this Hon’ble Court and thus render justice.
