In view of the series of protests against CAA, throughout our Nation, I ventured to understand the CAA, therefore, I read the CAA bill, Amendment Act as well as statement of objects & reasons.

I find no legal infirmity therein. According, to my understanding the rationale behind specifying Bangladesh, Pakistan & Afghanistan is that those Countries are declared Islamic Nations. Therefore, Muslims are majority in population, whereas Hindu, Christian, Sikh, Jain, Parsi are minorities who were subjected religious persecution are declared to be eligible for citizenship subject to the provisions of Foreigners Act & Passport Act.

I sincerely appeal that the opinion expressed herein is my personal as an member of the legal faternity 🙏

On the face of it, the implications of the CAA is to isolate individuals who identify as belonging to the Muslim community. If you restrict the understanding of the law, as the government would have it, to applying it only to immigrants, then this law automatically makes Muslim immigrants second class priorities when they are on Indian soil, even though they may have made the long trek to India for the same reasons (poverty, political persecution, etc.) that drove their Hindu or Christian neighbours out. If you expand the understanding of this law, as the government has overtly done (by linking the NRC to the CAA), it has implications of making all Muslims in India second class citizens. In doing so, this law and policy subverts and even destroys fundamental constitutional principles of secularism, fraternity, and humanity.

[12/29, 20:16] Sekarreporter 1: [12/29, 20:16] Sekarreporter 1: [12/29, 20:08] Adv Suryaprakasam APS: a INA freedom fighter pension writ appeal filed by the central government against the single judge orderfreedom fighter widow Mrs. Lakshmi directing the government to sanction her came up before the first bench consisting of justice A.P.Shaw and justice Ibrahim kalifulla and the union government argued that the said Lakshmi who is a Tamilian and came to Chennai as repatriate and settled in Chennai wasborn in Burma and as such she cannot be considered as Indian citizen but the bench dismissed the writ appeal of the government and held that Lakshmi father was a citizen of crown ( then British empire) and as such children born to crown citizens are deemed to be Indian citizens and further directed the government to sanction her NIA pension immediately
