[1/21, 00:50] Sivaji: 20-1-21 mahaveer shivaji MHC advocate: SECULAR: though this word inserted in our constitution later, by 42nd constitutional amendment act 1976, but it doesn’t mean that our constitution is not secular prior to this, because it contains several principles of secularism in part III. secularism means India has no official state religion that is government has no religion but all citizens have religion or may not have any religion.religion is private and individual affairs and it is not state affairs. the state has no right or power to impose any tax on religion.the the state has only limited role to facilitate the belief of it’s citizens.secularism is one of basic structure of our constitution and the parliament have no power to remove the same by using Art,368.or by separate legislation.even the political parties are prohibited to campaign on ground of religion, Which the election commission of India has to monitor, but it’s failed in it’s constitutional function. because of this word secular our country is not anti- religious or irreligious state. religion is universal one and conversion from one to other religions is fundamental right of citizens, state has no business to interfere or discriminate on the ground of religion. it is two fold rights state cannot discriminate it’s citizens on the ground of religion and the citizens cannot discriminate his fellow citizens on the ground of religion.further there is controversy exits in India, being a secular country how it possess religious laws in civil matters Viz., Hindu laws, Muslim laws, Christian laws etc.,all these are temporary one until uniform civil code come into enact by parliament under the principles laid down in part IV of the constitution…….. thanks and follows
