The petitioner / voter asked to vacate stay to enable the High court to proceed with Trial. Mr P. Wilson said that the election petition is not maintainable and hence vacating stay will prejudice Successful candidate who has to under go trial unnecessarily. Hearing the same the Hon’ble cji bench dismissed the vacate stay petition

அதிமுக தலைமை அலுவலகத்தில் புகுந்து முக்கிய ஆவணங்களை எடுத்து சென்ற விவகாரத்தில் பன்னீர் செல்வம் மீதான வழக்கை சிபிஐ விசாரிக்கக்கோரி நாடாளுமன்ற உறுப்பினரும், முன்னாள் சட்டத்துறை அமைச்சருமான சி.வி.சண்முகம் சென்னை உயர்நீதிமன்றத்தில் மனு தாக்கல் செய்துள்ளார்.

அதிமுக பொதுக்குழு கூட்டத்தில் கடந்த மாதம் சென்னையை அடுத்த வானகிரத்தில் நடந்த அதே வேளையில் பன்னீர்செல்வம் ராயப்பேட்டையில் உள்ள கட்சி அலுவலகத்தில் தனது ஆதரவாளர்களுடன் சென்றதால் அங்கு மோதல் எழந்ததாகவும், மேலும் அலுவலகத்தில் உள்ள முக்கிய ஆவணங்களை பன்னீர்செல்வம் மற்றும் அவரது ஆதரவாளர்கள் எடுத்து சென்று விட்டதாக ராயப்பேட்டை காவல் நிலையத்தில் புகார் அளிக்கப்பட்டு, வழக்கு பதிவும் செய்யப்பட்டது.

இந்த நிலையில் சென்னை உயர்நீதிமன்றத்தில் அதிமுகவின் நாடாளுமன்ற உறுப்பினரும், முன்னாள் அமைச்சருமான சிவி சண்முகம் மனு தாக்கல் மனுவில், அதிமுக அலுவலகத்தில் கடந்த ஜூலை 11ஆம் தேதி நடந்த கலவரம் குறித்து ராயப்பேட்டை போலீசார் தாமாக முன்வந்து வழக்கு பதிவு செய்து அதில் அதிமுக அலுவலக சுவாதீனம் தொடர்பாக இரு தரப்பினருக்கும் பிரச்சனை இருந்ததாகவும்,அதன்படி அதிமுக தலைமை அலுவலகத்திற்கு சீல் வைக்கபட்டதாகவும், ஆனால் அவ்வறு எந்த பிரச்சனையும் இல்லை என மனுவில் தெரிவித்துள்ளார்.

அதிமுக அலுவலகத்திற்குள் புகுந்து பன்னீர்செல்வம் மற்றும் அவருடைய ஆதரவாளர்கள் ஆவணங்களை எடுத்துச் சென்றதாக மாவட்ட செயலாளராக ஆதிராஜாராஜம் புகார் அளித்ததாகவும் அந்த புகாரை பெற்றுக்கொண்டு ரசீது வணங்கவில்லை எனவும் உயர் அதிகாரிகளை தொடர்பு கொண்ட பிறகு ரசீது கிடைக்கப்பெற்றதாகவும் மனுவில் தெரிவித்துள்ளார்.

இதற்கிடையில் எடப்பாடி பழனிச்சாமி அதிமுக அலுவலக்த்திற்கு வைக்கப்பட்ட்ட சீலை அகற்றக்கோரி தாக்கல் செய்த மனுவை விசாரித்த நீதிபதி, சீலை அகற்றி சாவியை இடைக்கால பொதுச்செயலாளரிடம் அளிக்க உத்தரவிட்டது. இதன் பின்னர் அலுவலகத்தை திறந்து பார்த்த போது சொத்து பத்திரங்கள், கம்ப்யூட்டர்கள், 37 வாகன ஆவணங்கள் உள்ளிட்டவற்றை பன்னீர்செல்வம் மற்றும் அவருடைய ஆதரவாளர்கள் எடுத்து சென்று விட்டதாகவும் இது தொடர்பாக கடந்த மாதம் 23ஆம் தேதி புகார் அளித்ததாகவும் ஆனால் இந்த புகாரை காவல்துறையினர் உரிய முறையில் விசாரிக்கவில்லை எனவும், பன்னீர்செல்வத்திற்கு ஆதரவாக காவல்துறை செயல்பட்டு வருவதாகவும் இந்த புகாரை சிபிஐ விசாரணைக்கு மாற்றி உத்தர வேண்டும் என்று மனுவில் தெரிவித்திருந்தார்.

இந்த மனு விரைவில் விசாரணைக்கு வர உள்ளது.
