[07/11, 11:55] Sekarreporter: Madras High Court Refuses to Halt Re-Release of Kamal Haasan’s Nayagn.
Advocate Vijayan Subramanian @lawyervijayan appearing for the distributor VS International Films, commenced his submissions, stating that Nayagan is a “cult classic” and a landmark in Indian cinema. During the hearing, Justice Senthil Kumar interjected, recalling his admiration for the film, mentioning that he had seen Nayagan “more than 15 times” and could recall its scenes “frame by frame.”
In a lighter moment that drew smiles in court, Advocate Vijayan Subramanian responded, “I have seen it more than 50 times and in fact, I am seeing the film again today.
Continuing his arguments, Vijayan Subramanian submitted that his client held a valid agreement authorizing the re-release and that the plaintiff’s suit was not maintainable, as there was no act of copyright infringement involved. He contended that the suit was misconceived and that the film’s re-release was fully within the rights of the distributor.
Agreeing with the submissions, Justice Senthil Kumar refused to grant an order of stay, holding that no prima facie case of infringement had been made out and refused to stop the re-release and ordered notice.
