From 07.04.2025 onwards, the present Writ Appeal has been listed every week and a series of mandamuses have been issued by this Bench, by exploring the possibilities of liquidating the properties of Kalaimagal Sabha. During the course of these hearings, the various properties spread over 33 districts in the State of Tamil Nadu, were segregated into two lists, one of which is free of any encumbrance and the other with encumbrances. We had also formed a Sub Committee for valuation of all these properties of Kalaimagal Sabha, in general, with a preliminary direction to the Sub Committee to focus on the valuation for the properties in Coimbatore and Tiruvarur Districts. On receipt of the Valuation Report for these two districts, the Special Officer had submitted before us an eauction draft notification. In the last hearing, we had suggested certain rectifications to be done in the draft notification, which has also been recorded in our order dated 03.12.2025.
2. We had also indicated during the course of the past hearings that the entire sale of the properties of Kalaimagal Sabha, through e-auction, will be monitored by a Monitoring Committee.
3. Now, that we have reached the stage of finalising the e-auction notification and its publication, we hereby constitute “ONE MAN MONITORING COMMISSION”, to monitor the entire e-acution proceedings for all the properties of the Kalaimagal Sabha, both with or without encumbrances, in the state of Tamil Nadu, Karnataka, Union Territories of Delhi and Puducherry. We request the Hon’ble Mr.Justice S.S.Sundar (SSSRJ) (Retd.), Former Judge of the Madras High Court to act as the ‘One Man Commission’.
4. We call upon the following two Advocates to assist the Hon’ble One Man Commission for the entire duration of the Commission or until further orders of this Court:
(i) Ms.M.Ezhilarasi, Advocate, Enrl.No. MS 2067/2014, Mobile

(ii) Ms.N.Premalatha, Advocate, Enrl.No. MS 2741/2015, Mobile No.8870115484.
5. The aforesaid lawyers assisting the Hon’ble One Man Commission shall represent the Commission before this Bench and all reports, suggestions or other views of the Hon’ble Commission shall be directly submitted to this Bench in sealed covers by either of them.
6. Kalaimagal Sabha shall pay a monthly honorarium of Rs.1,00,000/-
(Rupees One Lakh only) per annum to the Hon’ble Mr.Justice S.S.Sundar
(Retd.), on or before the 5th day of every month during the validity of the Commission or until further orders of this Court.
7. Kalaimagal Sabha shall also pay a sum of Rs.35,000/- (Rupees Thirty
Five Thousand only) to each of the two assisting lawyers, namely Ms.M.Ezhilarasi and Ms.N.Premalatha, on or before the 5th day of every month during the validity of the Commission or until further orders of this Court.
8. In the last hearing, we had requested the learned Advocate General to submit a revised draft notification, in accordance with which, a revised draft notification has also been submitted before us. Now, that we have constituted the Hon’ble One Man Commission, the learned Advocate General is called upon to further revise the draft notification, in accordance with the following guidelines:
a.All the bids in the proposed e-auction shall be placed before the Commission;
b.In cases, where there is no bid, the Special Officer may place a note before the Commission, seeking permission for
scrapping the e-auction process for that particular bid or for proceeding with the fresh auction;
c.To facilitate the Commission to prepare 3 to 5 of the highest bids in each auction;
d.On receipt of the report of the Commission of the highest bids, the Division Bench may call upon the bidders to increase their bid – offers, before declaring the highest bidder;
e.The Special Officer shall obtain the prior approval of the Draft Sales Certificate from the Commission before its issuance to the successful bidder;
f.The Division Bench shall thereafter, declare the successful bidder on the basis of the report of the Commission;
g.When the Special Officer is of the view that the e-auction requires to be adjourned / postponed / cancelled, he shall place a note before the Hon’ble Commission with reasons for such decisions. The Division Bench thereafter, may take a decision, based on the report of the Commission in this regard.
9. In accordance with the aforesaid guidelines, any of the terms of the tender conditions shall be modified, in general, and Clause 12(d), (e), (i), (n) & (v), in particular. For the purpose of incorporating the guidelines, any new condition may also be incorporated.
10. In continuation of our earlier order dated 03.12.2025, Ms.S.Prema, Chief Technical Officer from Kalaimagal Sabha, had demonstrated before us the highlights of Kalaimagal Sabha’s website. Among others, she had demonstrated that the website could be accessed by any of the members of the Sabha by using their login IDs. Likewise, the facility for the Department to login their own ID was also demonstrated. The website is accessible in both English and Tamil Languages. It is also accessible by mobile phones. For the existing members to enroll themselves, the website requires them to enter their membership number / registration number; name; status; and contact details. According to her, 4,095 have already registered in their website, out of which 3,683 have been validated. The details of the registration, validation, rejection and other status is communicated to the individual members, through SMS or e-mail. The members on enrolling themselves and logging in, will have access to the membership details of the properties of Kalaimagal Sabha and the auctions for updating their details, including update of legal heirs. We place our appreciation to Ms.S.Prema, Chief Technical Officer, for her clarity in presenting all these details before us.
11. Mr.B.Vijay, learned Additional Government Pleader is called upon to submit a draft advertisement to be published in the newspapers, calling upon the members, who have not registered themselves in the website, to register in the website, as well as to the already registered members for updating the details of their membership, etc. The Additional Government Pleader shall also submit a SOP with regard to the ideal mode, in which the entire auction process can be commenced and completed by the Special Officer with the approval of the Hon’ble One Man Commission and the final decision of the Division Bench in the next hearing.
