O R D E R
This Writ Petition has been filed seeking direction to the respondents to take further action in the petitioner’s complaint dated 15.10.2025 and also to direct the respondents to provide adequate police protection to the petitioner and his family members based on the complaint dated 15.10.2025.
2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents and perused the materials available on record.
3.The learned counsel appearing for the petitioner submits that
there is serious threat to the petitioner to his life and liberty. He would further submit that the petitioner is a practicing Lawyer and a member of the Bar Council. When the petitioner was protesting for not taking any action against some of the accused who attacked a lawyer in front of the High Court, the petitioner herein was continuously receiving serious threats. The learned counsel would further submit that the said lawyer was not only attacked in the road, but when he was going to Bar council premises, some of the accused entered the Bar council premises and once again attacked the said lawyer. Therefore, the petitioner has called for a fair investigation with regard to the said incident.
4.It is the submission of learned counsel for petitioner that
some of the persons have protested against the petitioner and used abusive and filthy language against him and also threatened him with dire consequences. All those statements were recorded and published in the social media. Despite a complaint being given before the respondent police by the petitioner, no action has been taken. Though CCTV footage in relation to the same is available, the same was not recovered and seized.
5.Learned counsel for the petitioner further submits that the
police remained mute spectator without taking any action, despite the fact that the alleged offence took place in front of the High Court premises and a lawyer was beaten seriously. The learned counsel for petitioner submits that no action has been initiated prior to the filing of the present petition and the FIR has been filed only after the present writ petition is moved and the FIR has been filed including the name of the lawyer who was seriously injured in the incident. Hence the present petition is filed by the petitioner seeking action on the complaint of the petitioner and to give adequate police protection to the petitioner and his family.
6.In the light of the submissions made by both sides and considering the nature of allegations made, this Court is of the view that a status report with regard to the alleged incident must be filed and the CCTV footages must be preserved and produced before the Court.
Accordingly, a direction is issued to the learned Additional Public Prosecutor to file a status report with regard to the incident and detailing the progress of the investigation so far. In the mean time, the CCTV footages in and around the place of incident and also in the premises of the Bar council with regard to the alleged incident shall be seized and preserved. The status report and the CCTV footages shall be produced before this Court in the next date of hearing.
