HC imposes cost on Trichy EPFO for delayed petition

Madurai: Madras high court imposed a cost of 1 lakh on Employees Provident Fund Organisation (EPFO), Trichy for a delay of five years in challenging an order of the EPF appellate tribunal, which had allowed an appeal by a private school against the EPFO order directing the school management to pay 42.99 lakh towards EPF contribution.

The court was hearing the petition filed by the regional provident fund commissioner, EPFO, Trichy.
A private school in Nagapattinam district is an establishment covered under the Employees Provident Fund Act. The area enforcement officer inspected the school and submitted a report stating that it did not remit the provident fund (PF) contribution properly.
EPFO initiated proceedings under the Act and passed an order determining the contribution payable by the school at 42.99 lakh in 2014.
The school appealed before the Employees’ Provident Fund Appellate Tribunal in New Delhi. The tribunal allowed the appeal in Nov 2014. Challenging the same, the petitioner filed the present petition in 2019.
