CHENNAI: The Tamil Nadu
government on Wednesday informed the Madras high court
that it is ‘actively considering’ the suggestion of the court to convert the Poes Garden
residence of former chief minister J Jayalalithaa
into the official residence of the state CM and not as a memorial.
Advocate general Vijay Narayan made the submission on behalf of the state government while opposing a plea moved by the Poes Garden Kasturi Estate House Owners Association (residents of Poes Garden) challenging the acquisition proceeding of the property to convert it into a memorial.

The association moved the plea alleging that if the property was converted into a memorial, it would affect the peaceful living of its members as the memorial would be frequented by thousands of people.
It further argued that the state had failed to follow due procedures in acquiring the residence besides failing to conduct a proper traffic impact assessment and social impact assessment in the area. There is no public interest in converting the property into a memorial, advocate L Maithili said, representing the association.
However, refusing to concur, Justice N Anand Venkatesh dismissed the plea as premature and based on mere apprehensions.
Justice Anand Venkatesh also noted that converting a residence into a memorial was not something new and that it had happened in cases of various leaders who had earned the love and respect of the people.
“The very apprehension of the association that a large population is going to visit the memorial and cause hardship to the residents itself shows that the association is aware of the fact that the late leader has a large following in Tamil Nadu,” the judge added.
