[08/08, 15:22] Sekarreporter: Today writ petitions filed by S.N.Subramanian the resident of Semmedu Village Gandhiji street, Ikkaraipoluvampatti Village Panchayat, Coimbatore District,challenging the approval granted by the Village Panchayat to Respondent Isha Foundation to construct electric crematorium came before Honble J Nisha Banu Justice, and Honble Justice M Jothiraman.

On behalf of Petitioner Senior Counsel Mr Issac Mohanlal represented Counsel for Petitioner M Purushothaman. Learned Senior relied upon the counter filed by the District Collector that the proposed crematorium is just 15 meters from the compound wall and about 20 meters from the house of the petitioner and further that there are two borewells on the two sides of house of the petitioner. Therefore there is bar under Tamil Nadu Village Panchayat Burial and Cremation Ground Rules which prohibit any burial or cremation within 90 meters from any dwelling house or water source.

Learned Senior Counsel for Isha Foundation Mr Satish Parasaran opposed the same stating necessary permissions were granted by the Village Panchayat.
The Honble Court was inclined to appoint an advocate commissioner to verify rival contentions. Latter Honble Court adjourned the matter by two weeks so that all the official repsondents filed their counters.

Yet another writ petition filed by one Murugammal and six other tribal villagers living near the propsed crematorium also was listed together.

Yet another writ petition by a neigbouring landlord one S T Sivaganam challenging the crematorium was also adjourned and he was represented by Learend Senior Counsel Mr Murali Kumaran.

State was represented by Learned Advocate General Mr J Ravinthran.
