PRAYER : Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the 2nd respondent not to harass the petitioner by compelling to lead a matrimonial life with the 3rd respondent under the guise of usurping her powers.

ORDER
This Court by order, dated 05.06.2026 directed the 4th respondent Dean, who was suo motu impleaded to conduct a complete medical examination on the health condition of the 3rd respondent victim and submit a report before this Court as to the feasibility of terminating the subsisting pregnancy of the 3rd respondent on 08.06.2026, since the victim required medical termination of her pregnancy due to the victimization suffered by her in the hands of the
petitioner.
2. Pursuant to which, the 2nd respondent police was directed to take the victim to the 4th respondent Dean. However, when the matter came up for hearing on 08.06.2026, the learned counsels for State of TN appearing for the 2nd and 4th respondents were bereft of report. Further, this Court directed the 2nd respondent police to promptly appear before the 4th respondent and explain her as to the necessity of filing a report in terms of the order passed by this Court.
3. Despite such order, today the learned counsel for State of TN appearing for the 4th respondents is before this Court without any report, but a piece of paper with medical terminology regarding the health condition of the victim and it is also seen MTP is planned after correction of anaemia, and the same is scanned as follows:
4. This Court is shocked to understand MTP means Medical Termination of Pregnancy. When this court has not yet passed an order to terminate the pregnancy of the 3rd respondent victim, but only sought for a report as to the health condition of this victim, the conscience of this Court is shocked to understand that a person who is holding office of high esteem like that one of Dean of a Medical College, has insensibly reacted to the order of this Court by sending an instruction to the 4th respondent that MTP is planned after correction of anaemia without proper report. It is also informed by the learned counsel for State of TN appearing for the 4th respondent that one bottle of blood was transfused. Hence, it is understood that the health condition of the victim is very bad.
5. The 4th respondent is directed to appear before this Court on
10.06.2026 with the report.
